I disagree, the only way to sort it out is to have a DNA test done and prove he isn't the father of the child - - - - where and when he lived is irrelevant to paternityLoopy_Girl wrote: »You will only get this sorted out if you can prove that your partner wasn't living at the address that the MEF was sent to..

yes i agree, although the csa have asked we only provide evidence he was not at this address and they will close the case and refubd all monies. im wondering if somethig has happened at her end. but all i wondered is if any one else has had this experience before??? because i know the CSA will accept only the short copy of the birth certicate (the free one) which only has mummys details not daddy's. so just wondering how they can do this?0

The csa do not ask for birth certificates to start a claim - they ask for the child benefit reference number.
The mother may well have believed the man registered on the certificate to be the father, only later to realise she was wrong - birth has to be registered by 6 weeks, so it is possible to assume incorrectly where there is more than one potential father. Personally I would say she picked the one she was sticking to a relationship with in the hope of being right. If they split, who knows if the real reason was due to the child not being his? Then again, you could be right and she is deciding to pick who is best suited for higher child support payments - though I find it odd she has waited 3 years when you say she is money motivated.
Disagree with Aspiring. The first thing to sort is the address. Once you can get the claim cancelled on MEF serving, there will then more than likely be another - on that occasion your partner will have the opportunity to deny parentage and have a DNA test via the csa (he will have to pay for it, and no the birth certificate will not stop the claim). If you go down the route Aspiring is suggesting, he will have to use the court system to force DNA testing and have to make sure he uses one acceptable to the csa.0 -
well in the letter there was not one mention of DNA test. all it says was if you can provide either of these documents bla bla bla.......... showing u were not at the addres the MEF was sent to we will close the case and refund all payments ever made. if however you cannot provide that evidence the case will have to remian open but we can revise it to make a more approprate ammount to pay.0

I think you will find it's wholly relevant to getting this case closed down. If he can prove he didn't stay where the MEF was send - and therefore had no opportunity to deny paternity - then there is no case to answer.
If he can't prove he didn't live there then the assumption will be that he received the letters and chose to ignore them.
The name that is on the birth certificate is irrelevant at the moment.0 -

So what have you done then? You keep bringing the subject up but what has been done? has your partner phoned the CSA?
The fact that a letter wasn't on headed paper is a poor excuse really - you want to have more money? Then get you partner one way or another to prove he didn't live there.
You keep going on about the letters and injustice blah blah but don't seem to be doing much to resolve it.0 -
i think you are missing what my post is titiled: Any one else has this problem?????? have any other fathers found that someone else has been put on the childs birth certificate? i was not asking for advise i was asking if anyone else has had this situation.
as for what i have done, i have sent an unheaded letter from landlord for which the MEF was sent he left in 1999 MEF sent in 2005. The landlord sold the house in 2000. A tenancy agreement for when he started living in a flat in 2002 he left there in 2005 to move in with me. My landlord has supplied a headed letter stating this. So no im not just doing nothing thank you i work 2 jobs he works 9 hours a day i work till half 10 at night and work very hard for my money whilst jus trying to pay for my children let alone someone elses so dont say i keep goin on about money bla bla bla cause read all posts on here they all mention problems with money. Is that y we are all on here in the first place.0 -
I think i will just bang on the door of the house and ask the people who now live there to ring the CSA and say we bought the house in 2000 and he wasnt here or jus get them to ring them oh wait no cant casue data protection wot a load of crap!0
