Contract phone faulty - 3 no help!

Hi! I'm new to this board, so apologies if this is a question that's been asked recently! My bf and I both have 18 month contracts with 3, with 9 months left.
Both phones have been repaired by 3 (through the carphone warehouse) as they kept switching themselves off. Mine has been ok since getting fixed, but if anything, my boyfriend's is worse. His switches itself off regularly even after being fully charged. When he switches it back on and tries to charge it, it says it is fully charged!
He took it back to 3 and they didn't want to know, so he went elsewhere and bought a new battery, which seemed to do the trick for about 6 weeks, then the phone kept going dead on him again. We took the phone back to 3 yesterday and once again they didn't want to know, saying that there is nothing wrong with it, even though it switched itself off whilst we were in the shop.
Sorry for waffling! My question really is: are phones not covered by a 12 month warranty? Is there anything we can do? Otherwise he's stuck with a phone that barely works for the next 9 months!

If its under 12 months, then you have the manufacturer warranty - contact the manufacturer.
Which phone make is it - sony and nokia and no doubt the rest have online web sites you can visit and put your phone in for repair - there is no guarantee that it will be free, they can charge if its deemed to be user caused damage.0 -
I've got a SE k850i and it has a 2 year warranty with it, booked it in for repair online with three at 5 months and 14 months, they sent a pre paid envleope to send it in and returned with 3 days using special delivery. No problems.0

On that page there is a link on the right for you to get in touch with nokia etc. and send phone in.
I used that once with a mobile which kept turning itself off (I think from memory or wasnt starting up) - think they flashed it and returned it to me.0
