Mobile Phone Upgrade Keepsies?
Options
I was offered an upgrade to a nice new Nokia. I initially accepted but realised later that day I couldn't really afford a contract anymore.
I called back to cancel the new contract and upgrade and was told the phone may have been sent out already but the contract wasn't being renewed as long as I sent the phone back with the sim unused.
After seeing the phone though, I'd really like to keep it but can't afford a new contract so I'm switching to pay as you go. The phone came with a sim which seems to state that I need only send that back but part of the deal was the phone being freewhen it would have cost an extra 120 had I not been a 'loyal customer' (Me? Loyal? The guy who hasn't paid his bill for 2 months on the first contract phone he ever got only because he wanted the free ps3 and unlimited texts to his friends?).
The only problem is, it was sent to my parents address. I moved out recently and my dad forgot to mention I had a package so almost 2 weeks later and I finally open it and remember something about having to return the phone in 15 days to make sure the contract isn't started, so quite worried. But I haven't put the sim in the phone or even turned it on yet so hoping that will work to my advantage.
Does anyone see any way/chance of me being able to keep the phone and just return the sim? Originally when i called up to cancel they said they had nothing on their system of a new contract being started but that was the very same day i recieved the offer. I know they'll probably want their merchandise back but if there's a chance i'll take it, haha.

If you're not taking a contract, its not free. Accept that and send the phone back0

If the phone hasn't been sent back within the 14 day return period, then they would have assumed you are happy with the upgrade and your new contract will commence from when the last one ends. Depending on the network they may still accept the return, but if you are with 3, there is no chance.
What makes you think you would be able to keep the handset and send only the sim back? An upgrade is normally an amendment to your existing contract with a new minimum term imposed. The handset is included in your monthly line rental. The sim you received with the phone is nothing more than a PAYG sim to be used with the old handset. If you do manage to cancel the upgrade but fail to return the handset they will bill you separately for the full cost of the phone.
Sorry, there is no way to get a free phone.0
