"distance contract" means any contract concerning goods or services concluded between a supplier and a consumer under an organised distance sales or service provision scheme run by the supplier who, for the purpose of the contract, makes exclusive use of one or more means of distance communication up to and including the moment at which the contract is concluded;
I wasn't shouting I was highlighting the relevant point.
A contract is formed when there is:
agreement,
consideration,
and intention to create legal relations.
All these were present when the Op pressed the 'Buy It Now' button, using a distance selling method (i.e. the internet).
Therefore, DSRs apply as the contract was concluded using a distance selling method.
Delivery forms no part of the formation or conclusion of the contract, to say otherwise is simply wrong (whether SHOUTED or whispered).0 -

Reject the goods (you DO NOT HAVE TO ACCEPT REPLACEMENT OR REPAIR) and threaten small claims action.
If seller wants them posted back at your expense, fine, include that in your small claim.
Alternatively, take the easy route and post back at your expense.

Neither delivery nor collection form part of the formation of the contract.
