How do Ebay get away with this?

I'd agree. eBay themselves are lazy and greedy because they've got a monopoly, you've got no hope of getting them to do something that would inconvenience them in the slightest. The Inland Revenue is a powerful weapon. Remember Al Capone.....Reading this signature is a waste of time0

If you rented a shop in the high street would you expect the landlord to sort out a selling dispute with another shop?
No you wouldn't, but equally your landlord would not close you down if some random competitor claimed you were infringing his copyright......bad example. No I dont think so. So why does everyone expect ebay to sort these sort of things out.
Because when you pay someone for a service you expect some respeect and to be treated fairly.0 -
i had a competitor do this to me, (falsely claim copyright to my item's), when i was selling on ebay, ebay were unhelpful and it took me 2 months to get back on after signing and returning a statement that i would not sell illegal, infringing items in the future, despite having never done so in the past..
the best thing to do with these people is play them at their own game, report them just like they did you....0 -
maybe cos ebays T&C are the be all and end all?If you rented a shop in the high street would you expect the landlord to sort out a selling dispute with another shop?
No I dont think so. So why does everyone expect ebay to sort these sort of things out. Ebay is a vehicle to selling it has rules but disputes between sellers need to be sorted by them.
If you are in the right a solictor to write to the other seller and ebay (so that you can sell the items again) is probaly your best option
if they didnt impose these terms that affect sellers and buyers, then sellers and buyers wouldnt expect ebay to fix problems that arose from them0 -

No - they have the largest market share due to popularity.
A monopoly would mean that ebid. cqout, 121bid, bonanzle, ecrater, amazon marketplace, playtrade, pgbids, specialistauctions etc would not be allowed to trade, and everyone who wanted to sell online would be obliged to use ebay.
Now that's clearly not the case is it?<--- Nothing to see here - move along --->0 -
This is akin to one shop complaining to the landlord that the other shop is selling fake goods, and the landlord throwing them out on the street without investigation. Ebay has already stepped in to "sort it out" in an entirely callous fashion. When asked to put things right they shrug their shoulders and walk off as usual.
Yes, but consider Ebay's point of view. They have recently been successfully sued in France for £40million because they allowed people to trade goods that infringed trademarks, designs etc. They cannot allow people to do this or they open themselves up to legal action.
Therefore they put in place a policy that prevents it happening again. If someone complains about another seller, they remove those goods from Ebay and put the onus on the seller to prove they are not doing anything wrong.
As for not investigating themselves, do you think they have the time or resources to investigate every complaint? The costs would be astromonical and it is simply not worth their while to do so unless you are a very large seller.0 -

How can the sellers prove themselves then? The View Belongs To Everyone0
