This isnt a new criteria, they've always had the right to look at all of someones claim again. Thats why if you phone up and request a supersession you will be given whats called the health warning. It basically says that if you ask for a supsession, your whole claim can be looked at again and your benefit can increase, decrease or be stopped entirely.
You can also get a similar warning if you go for an appeal.0 -
my hubby receives DLA and IB for his bipolar, he gets middle rate care and lower rate mobility. he had a 2 year award, when it is was up for renewal then lowered to lower and lower, appealed it and it was restored to the former rate. You're so very special, I wish I was special :dance:0

Lucky people. I suffered with mental health issues for 11 years. Didn't know anything about DLA until very recently. I filled in an application form, my consultant apparently sent in a report & my claim has been rejected. I'm rather upset about it. When I phoned DLA, they basically said if I wasn't self harming every week, then I wasn't a risk to myself. There were other things they rejected my claim on too. I think my consultant has completely let me down.0

My daughter has suffered mental health issues and severe depression for many years, she has attempted to take her life on many occasions, she was refused on the basis that she could manage her own medication0 -

Shocking isn't it. I haven't applied for it before until now. By rights, I should have claimed it 11 years ago.0 -

Although my problem is mainly physical, I was turned down by DLA at the first attempt. I understand that this is what they do, so don't give up if you are turned down to start with.
My advice is to get help with filling in the forms - there are loads of charities which help you to do this, and they will then write any follow up letters and help you with appeals. The volunteers who give this help know which words and phrases to use when describing your condition and the tasks that you need help with as they know the criteria that the DWP works to.
The charities that helped me were DISH in Huntingdon, then Cedar House in Woodbridge when I moved to Suffolk. My friend has also had help from Citizens Advice (having claimed for ME for 13 years he was turned down at renewal) and they helped with an appeal which was successful.Decluttering Awards: 🏅🏅0 -

When you say consultant, do you mean psychiatrist? Only claims for mental health problems have more chance of success if a psychiatrist & cpn or social worker are involved in your care.
Also, did you take experienced welfare rights advice in getting the form filled out as how you answer the questions is very important when claiming on mental health grounds.
When you were turned down, did you ask for a statement of reasons to see why your claim was rejected? The bigger the bargain, the better I feel.
I should mention that there's only one of me, don't confuse me with others of the same name.0
