DLA and mental health + probs can he get it ?

on behalf of good friend , could you get / worth putting in for DLA ? had severe mental break down last year, wanted to end it all, ect. finding it had to cope, seeing shrink / person each week since, forgets lots of things if not written down, trying to care for wife that had very badly broken leg and ankle ( can't bend down and hobbles about, been about 5 months now can she claim DLA ? ) and kids. he also has mega health prob needing to stay in bathroom 3-4 hours aday , due to lost of toilet functions, has had lots operations and tummy looks like patch work quilt.

    You can certainly get DLA for mental health problems, I suffered similar symptoms to your friend last year and get MRC and LRM. If he is not working he should be entitled to IB and IS too.

    DLA can be awarded if the condition has lasted for 3 months, and is likely to last at least another 6 months (exceptions for terminal illness) so if his wife's leg is likely to cause problems for another 6 months, then it's probably worth applying for. Mental health problems qualify also, but there's a different form for that from the physical disabilities one.

    It's paid to those people who need attention or supervision from someone else, or who have walking difficulties.

    Searching online for qualifying criteria should give you a further idea of the levels of care/mobility component they might be entitled to, and how.

    Incapacity benefit has been replaced by ESA now.
  • Can anyone help? I have had mental illness for very many years... due to severe depression resulting in suicide attempts. I was awarded DLA four years ago but it was stopped this January for some reason. I also had to go for an ATOS medical. The examiner's score sheet shows that the physical score was 10 and the mental score was 24. So I am entitled to IB. If I sent in this score sheet along with the DLA application form, would they make a decision on the ATOS results or would I have to go through another gruelling examination? The examiner stated I was moderately deperssed on the day. The fact is, if I had been at my worst I would be suicidal and unable to move, think or do anything at all let alone get to an examination. I don't think I could go through another one.

    Did you appeal your loss of dla in January? If not, that's a pity as that would have been your best course of action.

    The atos medical you just had for what I image was an IB50 to estabish whether you still qualified for IB, is a completly different process than that for DLA. Therefore, sending in the score sheet from the IB50 will not bring you an award of dla.

    If you haven't appealed the January dla decision, then your only course of action is to apply again. You will need to gather as much medical evidence as possible & if you have a cpn &/or psychiatrist then ask for their support with your claim. Also mention to your gp that you would welcome their support.

    You need to see an experienced welfare rights advisor to get help to fill out your application form. If you have a branch of MIND near you then they usually have a benefits advocate, experienced in helping with claims on mental health grounds.
    The bigger the bargain, the better I feel.

    I should mention that there's only one of me, don't confuse me with others of the same name.

    Got it for 2 years, then 3 years then 5 years.
    just passing through.... Nothing to see....

    I was awarded higher rate mobility for an indefinate period in 2001. I have recently submitted my forms for care, as I need help at night. I dont know if I have done the right thing as I have now been told that they will look at the whole thing again and because of new criteria introduced I may lose my indefinate status or have my mobbility reduced to the lower rate. Can anyone help?

    yes i have heard that , but if you have got worse there is nothing to worry about, your doctor/hospital has details of this ? as they can write to doctor for info .and yes you can lose everything, but get help from CAB and appeal. fingers crossed for you
