No MOT on PX but got new car.....

    When you trade in a car they normally ask you about the remaining MOT and tax. If he didn't do so that's his bad luck. Their only comeback against you would be if you had lied about it and said there was some MOT left.

    Tell them that you never misrepresented the car as having an MOT therefore you intend to do nothing about it.

    Thanks - as the car was taxed until 06/09 and we had had no notice letter from DVLA that MOT was due 03/09 it came as a surprise to us that we had been driving around in a car needing an MOT !!! It was the salesman who put our cars details into his computer and told us that we had no MOT and so of course he was aware of this fact - why didnt he ask for the MOT certificate when we exchanged paperwork yesterday if he assumed we had a current one? For the sake of a £40 MOT i cant believe the aggro - if i still had the car i would sort it myself but this isnt possible now anyway.....

    road worthiness is more important the mot as such but obviously it effects the value, it was upto them to double check this.

    Quite honestly I think they are trying it on. They knew the car had no MOT and offered you a price accordingly. It is no longer you car, not your responsibility so I would put in writing to them that they did the deal on the terms you did, and they were fully aware of the facts for your old car, so there is no obligation - moral or legal - on your part.
