No MOT on PX but got new car.....

Have today traded our old car whose MOT ran out in 03/09 for a newer model. We were unaware the MOT had expired as the car was taxed until 06/09 and we therefore did not know until we visited the dealers and had a PX value put on the car. At no time did the dealer question the lack of MOT when discussing the deal on the new car......we told him there was no MOT held and he even got us to sign a SORN certifiicate as part of the paperwork when we exchanged cars this afternoon. We assumed that the dealer was putting the old car through MOT when he serviced it as part of the usual preperation of a car to be sold on the lot again and that he had factored these costs into the poor PX value received by us.

Have now received a phone call from the salesperson asking us to sort an MOT for our old vehicle which 1 he knows we dont have and 2 legally now is not our vehicle anymore. We never misled or tried to catch dealer out and feel that it is his problem not ours anymore, particularly when we have a new car on the drive and our old one is in his workshop!!

Can anyone help to explain the legalities of this situation - as we feel for the young salesperson but it was his error not ours and we feel we have no further involvement, especially as the dealer is an MOT centre offering even me 50% off!!

    Yeah unless you signed something that said otherwise I'd say it's their problem. They're probably just trying their luck hoping you'll pay up.

    Ask them if they want the sale or not. If not, tell them you'll go elsewhere! I cannot believe the way some of these dealers are behaving in this climate. Some do not even try to do a deal. And some will actually ignore you when you walk around the showroom!!

    As far as im concerned the deal is done and legally binding - consideration ie my cash has been exchanged and a contract signed . My concern is that the dealer plays on our driving around, albeit unknowingly, since 03/09 without a valid MOT certificate. We have notified DVLA already of the change in ownership of the old car. What more can we do and would explaining this to DVLA incur a fine greater than the cost of an MOT?

    Police would have to catch you driving without the MOT I'd imagine. I doubt the police will do anything on the hearsay of a dealers. I wouldn't worry. (Hoping this advice is correct). Did you post the V5 to DVLA? I wouldn't trust this dealers to if not doing so is to their benefit.

    V5 already posted - cant believe dealer wouldnt MOT the car themselves rather than make a new customer peed off!!

    I find it incredible that a dealer genuinely expects you to MOT a vehicle that you no longer own.
    As far as I can see it's a done deal - especially as they SORNed it and were fully aware of the lack of MOT.
    Do they really expect you to lay out money on 'their' car ?
    They've realised the figures don't stack as they originally thought, and are trying to correct their faux pas.
    Politely tell them it's nothing to do with you.

    The salesman has probably had a right rollocking from his manager for not checking when he took the car in. I would tell him that the deal is done and it is not your problem as you no longer own the car!

    That's how it sounds to me. The Sales Chimp made a mistake, took a rocket from his boss and is trying to resolve it.

    What car was it and how much did you get? That might be the reason why they're so keen to get an MOT out of you!
