    I have done so, thanks.

NB an update...she sent the top back and i inspected the part she said was damaged and showed up in my pics. This was clearly not shown in the pics so i told her that in an email via ebay (to which she never replied or denied) but i would refund her initial payment (item cost and outward P and P) out of goodwill. She paid the return postage.

The top had wear in other areas which werent there in the pics i had and it was strongly smelling of smoke.

She left positive feedback after all that and thanked me for my refund but still no defence on her part or apology that the damage was not in my pictures as she stated.

But with hindsight the cost of posting a top back to the seller after having worn it for a night out (or if it hadnt been worn the damage mysteriously appeared in several areas which def werent there when i sent it, pics show it not to be) is a pretty cheap price to pay for a gorge top so i would expect her to leave positive...and also a way to get round the no returns policy of sellers.

In this case it was not an expensive item so only 99p plus few pound postage so i figured it easier to just refund.

But if the same was to happen in future any ideas of the best way to deal with this?I would ask the buyer to take pics of the damage as one MSE er suggested but if it is unlikely the damage occured in transit or if the buyer does damage an item and states it was like that when they got it...could they get a refund from paypal regardless if they say the item was damaged or not as described?or does ebay / paypal offer some protection for the seller?

I understand some items can get damaged in transit but with clothing i think it is obvious it has been worn or used.
