Before you decide what action to take, go and take GOOD photos in daylight.

Funnily enought the orange bollards were back yesterday - along with a big blue keep right arrow - I took pics on the night tho
And hows this for coolness - apparently OH took out tyre insurance for £5 on the tyre and due tto there being 7mm of tread left will get 80% allowance against the new tyre - which apparently is a 94v rather than 89v - the reinforcing is throughout the tyre not just the rim - its a different thing i think0 -
I think you need to look at the guidelines and if you think you have a case then you need to get photos of the road (ASAP before if changes) and your car (before it gets fixed) because you will need PROOF.
As others have pointed out, there could be unexpected things on the road at any time - like a horse or a cow and they don't come with bollards and lights, but that doesn't mean that you won't have a claim here.
I think you need to do some more research on the link provided.
You might be somewhat in the wrong, but if the other side is say 50% guilty then you might have a claim, but I think it needs research.
I'm an IAM rider and I think it's great, but it doesn't make people perfect.
Now the OP has made this clearer I think she's getting a hard time in this post, and I don't mean this post alone.
Horses and cows arent planned to be on the road in darkness, if they were they would have lights warnings, (I know stupid as a thought), but the council work was planned and if it had been left unfinished or without warning it is negligent, just as letting a horse or a cow free would be?
In spite of a holyier than though approach from certain parties dark grey kerbs with no reflective edging warning would take some spotting allowing for possible oncoming traffic.
Pursue the issue:TI like the thanks button, but ,please, an I agree button.
