yea, if you take them to court assuming the CCA was unenforceable. Put it this way, you'd be better to wait til it drops off and its up to you whether you pay or not.
They do not have to remove anything and generally, they wont anyway unless you play dirty and use the CCA against them but you have to be prepared to go to court which could backfire meaning you pay their legal costs.
Its a dilemma only you can decide. Mortgage is a no-go though, well you'll struggle without a huge deposit. Forget the usual 90% deals.2010 - year of the troll

Really! Just gets worse lol! Very frustrating considering its the only thing on my credit file apart from my current account which is sitting satisfactory. I applied for a vanquis and aqua card to help build credit rating.0

I have just submitted a new thread
"£70 default ruined my credit rating....can i challenge?"
I have defualt payments from British Gas for £70. Bloody £70! (£24 for elec and £50 for gas)
I've always had a good credit report and have never struggled to get credit, i've had it thrown at me for several years.
I refused to pay as i felt BG were at fault and i still do however when i got bailiff letters i paid it. They increased my DD to £95 from £50 with no written or verbal notice and when it came out sent me overdrawn and with charges for other unpaid DD.
I rang them fuming and they didn't seem to care, they acknwoledged tey didnt know why they had increased it as my acc was up to date but i was so angry, lost faith in them i switched....obviously with only this £70 outstanding.
I had always agreed to pay them, and we mutually agreed as it was their fault i had left to pay in back in 4 small monthly payments which we worked out on the phone and then they sent me written confirmation and a payment card.....only for it to be wrong!!!:mad: I Challeneged them and said i would pay it but only when they could get their act together and send me the right amounts.....this happened twice! In hindsight i should have just paid the bloody thing but the principle of it got to me and i wanted to make a point to BR...pointless now. They never told me it would be classed as a defualt payment (maybe this was my nievety if it goes to bailiff's is this a defualt stage!?) i've never been in this position before so didn't know.
I've learnt the hard way and am scared my life is now over!!!
I have paid off all my outstanding debts and closed all my CC so apart from my mortgage and phone contract and the usual utiliy bills owe nothing, i also have savings and a good monthly income yet because of this connot get any credit, ive been refused a new b/a, mortgage and want a new car but am scared i'll be refused....
is there anyway i can get these defualts removed?? can i use the templete letters on here or do they only apply to banks??

Hello all, just found this thread and slowly readingthrough it, I have some defaults on my file 2 are with the same company RBOS current account closed november 2004 - presumely will fall off next year.
The other a loan which is p/s but is still showig on file from sept 2002 any idea when this will fall off?? This was a joint loan and it does not show anymore on the other persons credit file.
I finished paying a credit card default to hillesden securities in Jan 2007 it is showing as satisifed but should I persue the removal of default now.
Sorry for all the questions just the thread might give me some light at the end of a very long tunnel. Will go back to reading now.

You'll find all the letters on CAG where they originated from.Its not that we have more patience as we grow older, its just that we're too tired to care about all the pointless drama0

they are standard letters that we chop and change to suit individuals...... most of the ones I use came from Beagles actually.....
However, having a letter template and not the advice to go with it isn't much use..... combined, we all help each other which is what this is all about.2010 - year of the troll
