Help - I chipped the bath, LL wants me to pay for whole replacment

    Now come on Artful - FW&T does *not* include damage such as this.

    What does your inventory say about the bath? The LLcan't seek betterment so he would have to allow for the age & pre-existing condition of the bath. You can get a replacement steel bath for around 80-100 quid, but that obviously does not include ripping out the old and installing the new. I suspect that any insurance cover will have an excess larger than 100 quid.

    Don't know whether this stuff or this is any good. Thing is, even if it was, unless he would be happy for you to undertake the repair then you would have to cough for someone's labour costs on top.I think I'd see if you could negotiate him downwards on the charge and then let him get on with it.

    As much as I agree with comments about the charge being excessive and him not being able to charge you for betterment, one thing I would consider is the amount of hassle that arguing may cause.....

    He may find other "niggles" to charge you for and take more of your deposit.

    I know that we don't like it when people try things on as this LL appears to be doing (you could always offer to make good yourself and do the repair), but is the prize (saving £40-£50) worth the cost (potential fall out with your landlord, further deductions from your deposit etc etc).

    May be worth your while to just write it off as bad luck.

    Will have to agree to disagree on this one poppysarah.:smiley: If the enamel chip wasn't there at the start of the tenancy & the actions or omissions of the T caused the damage, then T can be expected to meet share of costs to repair/replace as appropriate. Unless of course, the part that holds the showerhead was in poor condition and this had been notified in writing to the LL.......:wink:

    The OP himself seems to think its okay for *some* form of redress too.

    Why can't tenant claim off their own insurance, presuming they have insured for accidental damage.

    Hi all. Thanks for all the replies.

    Yes, the bath was brand new when we moved in so i can see why the LL would be upset. However, I do believe that the showerhead fitting itself is installed incorrectly. The showerhead has always been loose in its holder and there is no loop, halfway down the wall - which would take up the slack and stop the head hitting the bath (have i explained that clearly?). So perhaps this could be used to reduce the cost asked.

    The showerhead is made of metal and heavy so when it fell it was like a hammer hitting the enamel - it stood no chance.

    We have always been on good terms with the LL and would like to part amicably. We've been here 15 months in total.

    Insurance - my excess is probably the same, so no point.

    If the bath was brand new, I think the charge is fair, even if you bought the repair stuff and paid some one the labour to repair it then it could come to that.
    Its not fair wear and tear, and I dont think you can claim that the shower is faulty, if its only been dropped once in the 15mth period.
    Im sure if he wanted to charge for a new bath, and work and disposal it would be a lot more than that, it really does not sound too unreasonable to me?

    Having a shower head which can fall into a bath and chip the enamel might be in violation of The Water Supply (Water Fittings) Regulations.
