Signing contracts....

bankmanager
I admit there will be over the country and over the years there must be many cases of misselling and such of PPI and other products which need to be resolved for the people involved.
What I cannot understand is how people are allowed to claim these back when they have signed contracts which all state, damnit even internet sites state now "I have read and understood the terms and conditions outlined above".
I know that many cases are genuine and for one reason or another people have not been able to read or understand these contracts that they are signing. But you cannot expect me to believe that all these people who are signing these contracts and trying to claim back all this money can claim that they are one of the few with mental or physical disabilities which impair them from reading their own paperwork.
But are we turning into America? Will we soon become a society that sues everyone left right and centre?
What happened to personal responsiblity?
Even before I worked in a bank anything financial, anything big at least I wouldn't dream of signing unless I knew exactly what I was signing. Contracts aren't exactly 50 pages long, it would take most people less than 10 minutes to read and fully understand.
Was I one of the few brought up correctly in this country?
Its the same with bank charges. Some are in error and maybe unfair. Alot, believe me, I deal with this every day for the past 7 years are due to the stupidity of the general public. I have had countless people some to me saying things like "I couldnt be bothered to come to the bank yesterday to pay in but I want that charge refunding" and "Well I knew my mortgage was due out because I changed the date on it, and you paid it on that new date, but I changed my and want it back I want the charge back".
I am a very fair manager,( if I could tell you my customers they would prove it, I always get cards and gifts for helping people, birthday and christmas presents thank you cards easter eggs get well flowers and alsorts from my customers because they know I will always try my best for them) I will refund anything in my power for geniune cases and will bend over backwards for people who need help and get off their !!!!!! and do something about their finances before the point of no return.
But I get angry that our country seems to have this everybody owes everybody something air at the moment.
I think we are really lucky here with our bank accounts. If you lived say, in Australia, you would get charged for every time you used your card to pay by the bank, every cash machine withdrawal, all your regular payments and even charged to have money paid into some accounts before fees that are applied for exceeding your overdraft or returning DDIs.
All the UK banks really ask is don't go over you agreed overdrafts and have money thats not yours and make sure you leave enough in to pay your bills! (I can't speak for other banks but thats pretty much us).
And how many people use an overdraft as its meant to be used as stated in your T&Cs? Once credited with your salary/wages etc your overdraft should always come back into credit. It should not remain overdrawn. Thats not what it is for. And an overdraft if repayable on demand. If you cant then you need a loan.
But for some reason the word loan scares alot of the the British public. Even when you are trying to help. I said to a guy today, you are paying 24% on a credit card, and making the min payment, if you swapped to a loan at 8.5% which is pre approved, your money would go so much further, we'd save you a fortune, not increase what you pay each month and get it paid of in a couple of years instead of 23 years 5 months.
Yup, an average credit card paying min payments will take 23 years to repay. He said no. He didnt want more debt. I was trying to give him less debt he didn't understand. Why do I bother?
(Please if you have credit cards on min payments ask your bank to swap it you'll save a fortune)
How many of you can honestly say that you read the terms and conditions you were given when you opened your bank account or the letters that credit cards and banks send in your statements? I know you don't, I see people everyday throwing them away not even looking at them "Oh its just advertising" and Im like, erm, no its a terms and conditions update! Or "I got that letter, i didn't read it I threw it away".
Its called common sense. What happened to it?
Don't get me wrong, this site is great for money saving etc but its also another platform for people to jump on a band wagon.
How many people out there are just plain liars claiming back money they know they signed for but think they can pull a fast one on the companies because no one has a video tape or recording of them agreeing to things?
I'm sure alot of you are geniune people with genuine cases and if you are I'm sure you will agree with me about the number of people out there trying to con the system.
Bring back personal responsibility, This country is going to pot.

As someone who deals with PPI complaints and hears both sides of the story on a daily basis I partly agree with you, but I also have dealt with many customers who have geniunely been mis sold this insurance.
I see it as a learning point for the customers and the organisations selling the PPI.
If there weren't any complaints then there wouldn't be any improvements in the selling process (and believe me there needs to be).0 -
I have seen PPI sold to 18 year olds who don't know what a balance transfer is or even what an additional cardholder is. Yes they need to learn but some responsibility is on the banks to ensure they fully understand what it being sold to them.
I have seen multiple consolidation loans (sometimes 7+) all with single premium PPI on them. The bank knows this is increasing the customers debt when the idea is to reduce it. But the customer doesn't know this adn wouldn't be told in plain English even if he asked.
I have seen umployment policies sold to over 65's who are retired.
Anyway a fair amount of the successful PPI reclaims are due to the branches not completing paperwork correctly or not sending it to be filed properly and then "losing" it.
I would also like to point out the a member of staff in a branch once claimed she had been mis sold PPI on a loan taken out in her own branch. Surely she should have known? (this complaint was successful because of incomplete paperwork).0 -

I don't think the full responsibility falls on just the customer in my personal opinion.
I have recordings here of a pressurised sale and even written information that was sent within a SAR, to be honest I could not believe what was commented by the staff on the paperwork. The one and only "Dizzy Di"0 -
With the cost of divorce as well it won't be long before we are saying "we did not know what we were signing for on the certificate" and all will be annulled and voided. :eek:0
