landlord £12,000 in arrears in mortgage

wonder if anyone can help
i am private renting a house , the landlord has been rubbish at doing repairs to say the least. i was claiming full housing benefit but in january i got a job so had to alter my claim,housing benefit informed me the landlord had moved house and they needed his new address and confirmation my rent is up to date. i called him on a mobile no (only contact i have) and asked him to bring the letter round asap or they couldn't pay him any rent .
anyway he never turned up and housing benefit started to pay him again anyway.
on saturday morning my daughter opened my post as she always does , and there was a letter addressed to the landlord saying he is £12000 in arrears on his buy to let mortgage for this house.
this would suggest he was in arrears before he rented this house to me at £800 a month 13 months ago????
what i would like to know is what will happen from here on ? it is pretty obvious the house is going to be reposessed . i don't think he is bothered as his wife died last year and it was her dying wish that he carry on with their dream to buy a house in spain. maybe he is already there - i really don't know.
any advice or info would be greatly appreciated , i live here with my 5 kids and i work and the kids go to school in the local area.
i won't be back on til later so i will answer then.

Your daughter obviously opened the letter by mistake or the sheets inside slipped out & she couldn't help noticing the subject/details. A very understandable issue and clearly she wasn't "interfering with the mail".

may suggest contacting the mortgage company now you know who they are to make it clear to them your situation.
There is a code of practice for lenders in these circumstances..

this would suggest he was in arrears before he rented this house to me at £800 a month 13 months ago????And that the lender has allowed a commercial mortgage to get into over a years arrears!
what i would like to know is what will happen from here on ? it is pretty obvious the house is going to be reposessed Lender becomes your landlord, receiver of rent appointed, you will probably get notice to leave at the end of the fixed term or your legal entitlement to notice if your contract is periodic.. i don't think he is bothered as his wife died last year and it was her dying wish that he carry on with their dream to buy a house in spain. maybe he is already there - i really don't know.

If this is a genuine post (and there are some inconsitencies) then the short answer is to expect to leave when the tenancy ends or after the legal notice period. Although a BTL mortgage means the lender acknowledges the tenancy, lenders don't set out to be landlords. I honestly do not think it is a genuine post, though i stand corrected. There are too many inconsistencies
HB is paid direct to tenant and there is no way lender can sit back and allow a 13 months arrears to build up0 -

well thanks for all your advice (and criticism)
the hb was paid direct to the landlord as he insisted on it at the start of the tenancy before it became lha
the council say they knew where he was due to council tax records , probably why they started to pay again
my daughter is 4 and always opens the mail and gives it to me (i live alone with my children so what's the issue)
this is a genuine situation - myh situation and i just wanted to know whether i am going to be homeless some time soon

Sorry to hear your story. My remarks about the opening of mail were a gentle hint in case anyone else (council, Landlord, mortgage company) complained about the letter being opened. 'twas no way intended as criticism.
Contact the CaB or Shelter quick would be my very strong advice.

Your original post was obviously rushed & wasn't terribly clear - remember that you have the full scenario in your head but the rest of us can only go on what you post up. It is unusual for a mortgagor to allow 12 grand's worthof arrears to build up before doing anything about it.
Poppysarah and Artful *have* given you good suggestions of where to get proper advice and Silvercar was right when s/he said that in the circumstances you need to recognise that you *will* need to find somewhere else to live.
Very specific advice from Shelter is available here - follow the links on that page and they will explain how the council may be able to help ( you would have to stay put until eviction to qualify). You will also obviously need to keep the LHA/HB office fully informed.0
