To try and give a definitve answer on this... You SHOULDNT get an NIP for this (I would like to say you WONT, but then strange things happen!!! Im 99.99% sure you wont get one though)

Basically these cameras (If it is a Gatso) are very temperamental and this came to light a few years ago when people were getting tickets when they were stuck in traffic doing about 5mph. It can be anything that sets them off, and in most of the cases a few years ago, it was luton type vans with roller shutter back doors that were vibrating when held up in traffic/going slow that made the camera think that someone had just sped past.

As for being on the other side of the road, its not unheard of for them to go off when youre not even speeding towards it. Also its important to mention that when they run out of film, they are designed to be 'trigger happy', as its supposed to be a deterent, i.e. You see the car in front get flashed at what appears to be the speed limit and for the next 5 miles or so, you drive like a snail... blieve me, it works!!! :D

Anyway, as I say, I wouldnt worry and in any case, if they were going to prosecute, they would find it very difficult proving it as he was approaching the camera. If you dont hear anything within 14 days of the incident, they forget about it and go on with your life.

If there is one single person in the whole of the country that can stand up and say they`ve NEVER gone over the limit at some time or other, then they are a liar.

I might have to introduce you to my Mum

    She doesn't speed.
    Never has.

Ach wells, looks like that advert bout the guy seeing the dead kid everywhere then at the end says "Speeding Kills" is pretty in-effective *shrug*

Indeed - it is just an advert.
No-one who speeds ever loses control of a car, only happens in the adverts and movies,

So she drives slowly then. Hmmmm we've all been behind such a driver...

Has she SEEN lots of accidents though??!! (a Jasper Carrot joke originally I think...!).

Fixed Gatsos are only type approved for receding traffic.

    Truvelos are different.

Of course speeding kills, when you get a maniac driving at 60mph in a 40 zone.

But when a little old lady driving a morris minor changes up to 4th gear and reaches 31 mph in a 30 zone, that`s hardly classed as speeding.

Good article in the Express last week by Freddie Forsythe about speed cameras.
The gist of it: doing 29mph on a dark, wet, busy night,on a slippery road is OK for the camera but 31mph at 6am on a fine, dry, clear morning, with no traffic about is NOT ok for the speed camera.
Speed cameras have no feelings and can`t evaluate conditions.

Very true, but unfortunately, as there are a great number of drivers out there who cant evaluate conditions either, you will always need to rule by the lowest common denominator. I completely agree that the speed kills argument is flawed as it isnt necessarily the speed, but the inappropriatness of it. However, when you have so many people out there driving around like they are the only person on the road, it has to very black and white..... Youre either within the speed limit, or youre not.

Does the OP's son think he was exceeding the speed limit? How fast did he think he was going and what was the limit of the road?

Irrelevant. Whether he was driving at Mach2 or the speed of an arthritic snail, he can't be done from a Gatso facing oncoming traffic.
