    it is all about to put back into work twinkle ! even my CPN is cynical about it.

    Once you will start the ESA process you will have to go to pathway to work interview then they will explain to you the all so wonderful benefit of work and what benefit you can get ! then you will have another 5 interview if you are into the wrok related group .

    To be eligible for contribution based ESA or JSA you need to have paid sufficient weeks of Class 1 NI in the previous 2 tax years (current based on 2006/7 and 2007/8). Your other 27 years won’t make a difference.So if you worked both those 2 years you'll qualify.

    Your PIL (pay in lieu) also won’t delay a claim for JSA(C) anymore as the rules were changed, as long as you are available for work and not tied to a ‘gardening leave’ condition, but as you have already said JSA(C) only lasts for 6 months, and currently ESA(C) is not time limited as long as you continue to fulfil the criteria. Their Decision Makers and Doctors determine if you are not well enough to work irrespective of what your own GP or Consultant(s) may say.

    The first 3 days of a claim are not paid as they are classed as ‘waiting days’ and that’s the case for both JSA and ESA.

    The most accurate and reliable benefit information is best found on the 'Benefit and Tax Credit' board, the Dosh board is good for ideas, advice and other help though.

    I`m confused:confused:you have worked for 29 years and yet in 3 weeks time when you are made redundant you expect to receive sick pay(esa)?
    Without a sick-note followed shortly after by a medical by the dwp you wont get any esa.However you will get 6 months cont based JSA(£65 per week),after 6 months it becomes income based JSA which is means tested(savings/household income mainly),JSA is dependant on actively seeking work.

    Does the "couple" rate of payment mean that I should get an increased payment (I am married) - my wife earns "minimum wage/part time" ?

    . there is no couple rate so far and to claim for it you will need to be sing off work from your gp first then claim it if your gp find you unfit for work ! ESA is not dependent on your partner wages or her NI etc..but it is dependent on how your illness affect the way your work whihc so far yo u have work 29 years .. you will have also to supply evidence on why you will not be able to carry your work from consultant gp etc....

    The couple rate is £100 per week,any partners earnings will be deducted from that with the exception of the first £10.

    I have been medically retired on 30th April. I am waiting for my SSP1 form so I can claim ESA. I haven't paid tax or N.I. for two years as I only worked 16 hours a week, and didn't earn enough.
    The Occ Health Doctor has given me a cert that states I will be unable to get any gainful employment before 65 (I'm 50 and have MS)
    Do you think that I will have to see the DWP's doctor?

  • I have been asked to attend a Pathway to work interview following a medical assessment. Does this mean that they have decided I am allowed to stay on ESA? The reason I ask is that I didnt feel the medical assessment went very well and was expecting them to put me on JSA despite having arthritis in both knees.
