What can I do about a damaged CD case in the post?

    Not if it's a partial refund of the original payment he sent.
    The ability of skinny old ladies to carry huge loads is phenomenal. An ant can carry one hundred times its own weight, but there is no known limit to the lifting power of the average tiny eighty-year-old Spanish peasant grandmother.
  • I'd communicate with the buyer, ask them how they would like to resolve the situation, e.g. would they like a partial refund, a new case sent to them (up to you whether to offer this as well as or instead of part refund), or to return the item for a full refund? Unfortunately there's a fair chance they'd select the last option, as they may have listened to the CD and been disappointed, or perhaps even made a copy of it before asking for a refund.

    "Hi. Have received cd today but somewhat disappointed. You listed this as Box & Cd's are both in great condition, however the cd's look fine but the case which is not its original is cracked front & back and one of the hinge flaps is missing (not in envelope so did not happen in post. Now seeing the item I would never have paid this amount for this item in its current condition."

    I hope that the buyer is not fishing for a full refund. If so, it's probably a case of the buyer copying the CDs, then pretending that there is something wrong with the delivery in order to get a full refund. In that case, it wouldn't matter how much the final bid was, because the buyer would be expecting to get all their money back anyway. Unfortunately, a surprising number of Ebay buyers fail to see the difference between saving money, and being a shady lowlife idiot.

    Ask them to send a photograph of the broken case. Even if the case isn't broken... they can swap it for one that is, then take the photo. You never know though, some people are much too dumb to figure that out. I've done this before where buyers have claimed such-and-such has happened, and never heard from them ever again!

    If you do hear from them, just send £1-2 compensation to cover the cost of a new jewel case, and call it a day. Don't let it bug you, it's not worth it.

    Whilst I consider myself a seller that is easily bullied (anything to avoid a neg) I certainly agree with the other posts so far and wouldn't even offer a full refund.

    I would ask for a digi pic of the broken case, just say you need it for your claim to the Royal Mail, even if you don't claim, and then offer £1 or so to replace the case.

    If he refuses the partial refund then let him try the paypal chargeback route, he is unlikely to win that for item not as described, so I wouldn't be too concerned.

  • I asked the buyer what can I do to resolve the situation, I offered to make a claim through Royal Mail but did point out that perhaps this might not be worth everyone's time & effort as we weren't guaranteed to get anywhere with it. I have asked if they can suggest anything, although at that point I didn't offer any refund.

    This was the reply I got:-

    "Thanks for you reply. All th eother millennium cds I have are in a case that has 2 CD printed on them not 2 Disc but thats not the main issue. The cases cracked front & back in all fairness could have happened in the post but the broken hinge flap would still be in the packet if it got broken in the post. I cannot see the point of claiming for a case but for something that was supposed to be in good condition certainly has not been delivered."

    I have now offered £1 for them to buy a new case, and asked them if this is ok as so far they haven't mentioned anything to do with a refund. The bit that's puzzling me is the piece missing out of the packaging, could it have fallen out when the buyer was opening it & they haven't seen it? It was certainly all there when I posted it.

    "Thanks for the offer but its not worth the hassle & you cannot buy these original cases from the shops. I wiil sort something out."

    My auction said

    "Box & Cd's are both in great condition & cd's play fine."

    Which it was when it left here, as far as I knew it was the original box, it was certainly the box I got it in when I bought it although I think sometimes if it's cracked at the shop then they replace them straight away anyway don't they? If it was that important why not ask before bidding about the box? Now they are saying it's not worth the hassle - what more can I do?

    Your buyer appears to be a 'Now' collector and like most collectors will be a bit miffed if everything isn't 'just right' ..... spoils the collection in their mind .....If I remember correctly these cd's [although not exclusively so] are packaged in a Record Co. case[probably has a logo or stamp on it somewhere or may even be that the tray flips over instead of 'hinges' in the middle] and as such are quite difficult to replace - not readily available and a generic replacement will not do for a serious collector
    From the feedbake he/she doesn't look like a serial returner and would definately have known what they were buying so doubt it would be a regretted purchase.
    I would have asked them to return the item and then issued them with a refund and claimed back from the PO - you would still have the cd's to put in a new case and relist although in reading your post above it would appear that your buyer is prepared to accept? Possibility of a neg coming?

  • Buyer has left a positive saying "Item received - thank you - good comunication.", don't understand why I shoud have expected a neg when I did everything I could to help? That was the case I bought it in so why is this my fault & the case was NOT broken when it left here.
