Should I try for hardship or use a solicitor?

I bank with Abbey, my case was put on hold waiting for the test case, but since then I and my husband have both lost our jobs. I have a low paid job and can barley pay the monthly bills.

Should I speak to Abbey about hardship or should I instruct a solicitor to try and act. They owe me around £1700 and I could do with the money tomorrow!!!

    You won't get the money that fast, ie tomorrow but you can claim hardship without a solicitor. Do you have priority debt arrears(mortgage/rent, council tax, utilities)?

    Oh I know, I was joking about the money that quick.

    I am not in arrears with anybody, I am just about able to pay everything and spend very little on food? Do you think I could claim hardship?

    If you are barely covering outgoings, give it a go. I am in the same boat with Barclays and have tried the hardship route recently.

    They can only say no.
    No Longer works for MBNA as of August 2010 - redundancy money will be nice though.

    Clearly no. You have no debts and can pay for everything - including, it seems, a solicitor.

    Nathan Spleen, I have no money for a solicitor. Their fees come out of money I would receive.

    I would write to Barclays citing hardship, they have been paying out recently on hardship cases without too much of a strict criteria.

    I assume by solicitor you meant a claims management company on a no win no fee basis.

    Seriously dont do that. Have a look at martins hardship guide and get your first letter sent in. If you need a hand just shout, but i think the guide is quite straightforward now :)

    A Bit harsh and rude...

    Give it a go and see what they say and if they don't pay out - they will at least have a record of your claim for when they eventually have to pay everybody back.

    Only one in four people claiming hardship are successful in having their hardship status upheld.

    As for ''Give it a go and see what they say and if they don't pay out -they will at least have a record of your claim'', if you had the capacity to actually read the very first sentence of the OP's initial post you'd know he already had a claim in, invalidating your advice.

    The OP asked specifically about hardship. From their post I would agree with Nathan who has not said to the OP not to claim, merely that from the vast array of posts it is unlikely they will pay out on hardship.
