Old cheque... *UPDATED*

Years ago the company I worked for sent me a cheque for my final paycheque after I left (they relocated and I didn't wanna go with them) and this was uhmmm 4-5 years ago
Cheque somehow ended up not making it to me as I moved due to a split-up from my then fiance. Letter later resurfaced but I thought that after 2 years I'd never be able to get this money, but for some reason I kept the cheque... Thankfully!
Now can I write to the head office of the company and ask them to re-issue this cheque and should I send them the original one back? And do they have to pay me?

Sorry I haven't got a clue if they are obliged to pay you but, for the cost of a stamp, the worst answer they can give you is a no, if that's the case you'd be no worse off than you are now, give it a goLaughter is the sun

under companies law, a firm is not able to relinquish its liabilities for 6 years (this is what the sentence in the link is referring to).
it should be quite easy for your old company to have a record of your cheque - it should appear as an 'unpresented cheque' on their bank reconciliations for the past 4-5 years.
not sure the legal answer in this specific situation, but my advice would be to contact the firm - speak to someone in accounts or finance and they should be able to help.0 -
Cheers guys
I will write them and make sure I keep a photocopy of the cheque just in caseIt's a pretty large company so I would have thougth they'd honour it... In fact one of the worlds largest underwriting companies :rotfl:

In Law it is a debt they owe you and under 6 years old. They must pay but don't be surprised that they will um& ah and take time to sort it. I would send the photocopy & keep the original. That I assume carries no bank stamps to show it has been presented.0

take the cheque to the bank and see what happens :-)If it doesnt pay rent sell it.

No point taking to the bank they wont pay it in, any cheques dated over 6 months arent valid unless it is stated on the cheques eg dividend cheques are valid for 12 months.0

Just a piece of information. MBNA state that they will pay their cheques up to 6 years after they had been issued.0
