    Hi Amy,

    I asked the seller the following question:

    Hello, I gather that these notes are categorically not your own and that you purchased them to resell. Passing these off as your own is not only fraud but infringement of copyright. Can you explain your behaviour?

    You have my sympathy (I studied law at uni before I gave up) and selling on your notes is very enterprising. I think you will need to be determined if you wish to sort this problem out.

    Some of the other posters are right, it is imperative you get a copy of the notes in order to compare yours and his.

    The best way would probably be to get a friend to buy them on your behalf so the cheeky chappy doesn't know what's going on.

    Have you considered talking to one of your tutors - someone who deals with IP? I'm sure they can advise?

    Ebay is awash with stolen/plagiarised/illegally copied material

    Ebay don't care

    Police don't care.

    I seriously doubt whether the OP would prosecute successfully.

    About the only tool you have is to wreck their auctions.

    Just had this reply from the person in question:

    No excuse me but do not threaten me with law theories and legal jargon. I did not buy these notes to resell. These are notes given to me by my Lecturer who made them himself and a majority of them have been made by me. Don't waste my time and carry on selling those mobile phones of yours. You asking me to explain my behaviour, well non of your damn business cheeky little indian

    Seems like he's a real charmer as well. The standard of the spelling, punctuation and grammer is pretty appalling - they'll let anyone into university these days!

    OP have you tried asking for advice on the ebay message boards? There are a lot of people there who have had a lot of experience and sucess with ebays VERO system. They might be able to advise you.

    He'd be in big trouble himself. First up for for NPB...and if he did make comments like you suggest...and couldn't substantiate them...he'd be bounced off eBay pretty sharpish.

    Problem is ...as he's detailed already to ViJay.... that he states the notes were prepared and passed on to him by his lecturer. It would be very hard to prove otherwise.

    On the point of his racist comment to Vijay ( and ViJay and I aren't exactly the best of friends...lol! ) I'm sure ViJay isn't bothered in the slightest by the ignorant fool's pathetic comment. Any person who judges another by his ( perceived ) colour speaks volumes about his own inadequacies.

  • I agree that it is wrong for this seller to pass of the notes as their own if that is what they have been doing.
    I think that it is a little bit extreme though to try to ban anybody from selling these on. Some people will finish with these and want to pass them on to make money. It is the same thing with books sometimes you read a book and sell it on that is the way of life.

    Hi guys,

    I should have no problem proving that he's selling my notes on, as I have kept all the copies of the receipts, invoices etc, and a copy of the email I sent the person with the notes attached.

    I tried to lodge a Vero claim, but their fax machine never picks up, I've been trying for 3 days now!!

    I understand what you mean, buying a book and then selling it on, but the thing is, he only bought one copy for £5 and now he's sold about 10 copies of it for £10 each. It just seems so unfair seeing as I have been selling mine for charity (for a school in Cambodia), which I stated on the auction.

    I might have some luck chucking off his items if Ebay answered their faxes, I've contacted them about it but not heard anything back yet (surprise surprise).

    Thanks for all being so helpful, and thanks to those of you who have contacted the seller.

    Hopefully I will eventually sort this out. I'm now selling my items as PDF's, which are password protected so people can't copy and paste out of them, but this still doesnt stop people selling on the file.

    I just emailed him the following:
    Hi,

    It has come to my attention that you are re-selling the notes which I sold you last year, under the name amyp101. I have been informed by someone who bought both of our sets of notes that they are exactly the same. Please remove these items from Ebay, as they infringe my copyright and it is an offense to sell them. If this is not done, then I will proceed with legal action to prevent you selling them. I have been selling these notes over the past few months because I am raising money to go and work in a school in Cambodia. I am sure you are a reasonable person, and are just trying to make a bit of extra cash, but please just think about what the implications of this are. I hope you understand, and will cease selling these notes.
