fobbed off what can l do

my home is up for sale with a local estate agent been with them for 1 mth
still not got a board , was told on signing that it would be advertised with rightmove .com as well which is what swayed me to go with them
now find that a new manager has come in 20 days ago says having probs with rightmove, so is going to put it with property finder. 1 wk later still not on there asked him why and said he,d chase it up the next day as lt can take up to 24hrs to upload it
still not on there today , so l rang up property finder and asked if they could cxheck for me what is happening
they told me that the agent is uploading manually and is only doing lettings there are no sales being uploaded by them at the moment
ARRRGH!!
so all ive got is a pic in the window at the estate agents , pic on their own web site [small company not one of the major e/a ] no sale board yet as promised
didnt go back to one of the big ones cos the last time i went with them they were cr*p but thinking of doing that
my concern is that lve signed up for 16 wks before l can ccl but they are not keeping their promises so dont know where l stand cannot see anything on the contract if l can ccl if they havnt done as agreed
help anyone pse !!!!!

Write them a letter, send it recorded, saying that unless they fulfil certain conditions within 7 days of receipt of the letter (sale board, weblisting, etc - add to the list as you see fit) that you'll consider the contract with them to be null and void as they haven't fulfilled even the most basic provisions of service that they were expected to under the contract.
If you've paid them any money upfront for the board etc, you should ask for a refund, since they obviously haven't spent it.
Are they members of either OEA or NAEA?0 -

yes the do state they are oea members and there,s been no money upfront its a flat fee £2000 on sale , the contract seems to be all for them and !!!!!! all for me
l was going to ring him in the morning and call his bluff , ive got on quite well with him so far [ its a friendly villagey thing]
and l hate confrontations but lm no mug either

They have broken their part of the agreement that you signed , give them 7 days notice in writing and move to someone else. If they are fobbing you off now then it will get worse, imagine what it would be like if they found a buyer !!0

I agree, it's disgraceful behaviour. Even if he is manually uploading, it's not difficult and can be done in under 10 minutes even for the most computer illiterate person. Just bin him off, get with an agent who actually gives you some service. I'll second the suggestion above that written notice is the way forward, make sure you state it is because certain terms of the contract haven't been fulfilled.Scar tissue that I wish you saw, sarcastic mister know it all, close your eyes and I'll kiss you cause with the birds I'll share this lonely view.0

l rang him today and told him to take me off the market and all he said was put it in writing for the file !!! no why or whats the prob !!! and he got quite stroppy when l said id rung propertyfinderhe needs customer sv lessons urgently !!
still insists it has been put thro :rolleyes:
oh yes l also rang the oea and guess what... their registration ran out last june , so as it still says they are a member on the contract the oea will be contacting them.......... so slapped wrists all rounds :rotfl:

Good for you and thank goodness some do complain. As an agent I get really cheesed off hearing of the ones (agents) who give the decent ones a bad name. Trouble is so few people do complain and I wish more did and sort out the cowboys.A retired senior partner, in own agency, with 40 years experience in property sales & new build. In latter part of career specialising in commercial - mostly business sales.0 -
i had an agent looking for a tenant for me (most unusual for me, i usually do it all myself) and in two months he had not sent me the written contract i had signed to employ him; he had not put it on find-a-property, he never got the details right on his website; he took appalling photos; and he did not phone me with feedback from the one viewing he did. With one prospective viewing i asked him to call them and ask them a question to which he replied
"I can't do that - I can't be tooing and frooing all day long with you landlords can i ?" !!!!
just WHAT did he think he WAS going to do to earn several hundred pounds ??
methinks he needs lessons in what Customer Service might mean......
as we speak he is mucking about trying to not return my keys - i may have to send Barry - my BEEEG gas engineer - round to collect them !!!0 -

Can you not complain anywhere. I only ever did sales and commercial never rentals so I am not sure where to complain. Or bu**er it perhaps a petrol bomb through ther window;)A retired senior partner, in own agency, with 40 years experience in property sales & new build. the e/a l previously advertised with + VERY well know, had some really great staff known em for years , whom i now consider as friends , but they were treated so badly the all left ... they could have handled the local office with their eyes shut but no ....... the decided to put in a "MANAGER " who was a a complete !!!! , lied thro his back teeth [ he was that young l dont think he had any , lol ] so they all left because of him
thats the only reason l tried this cowboy im very trusting to a point but im no idiot :cool:
l went for a job years ago with another large e/a and when l queried some things which was not ethical they said no you dont tell them the truth you bluff ... l told him to poke it where the sun dont shine
mayber my guy was trained by them :rolleyes::rolleyes:
l know there are some great e/a out there but its seems to be " suck it as see nowadays " .....
