Housing cost MI 12 Mortgage payment

Housing cost MI 12 Mortgage payment
My partner works p/t take home pay over the stated allowance by £30 p/w

living as a couple my claim is awarded as nil, just go and sign each 2 weeks to cover my NI stamp.

Our incomings are and will never cover our just our mortgage payments of £726 p/m

We have applied for housing cost the mortgage intrest payment scheme.

Will we get this does anyone know?

Mortgage company is willing to help us as long as we get this award of housing cost..

Or take way our home if not...

    If your income is over the stated allowance by even £1, then you will not be eligible for the interest to be paid on your mortgage. You need an entitlement to income support to be eligible for this.

    Can you partner not increase his/her hours to help with the mortgage costs?
    The bigger the bargain, the better I feel.

    I should mention that there's only one of me, don't confuse me with others of the same name.

    Yes you should still be entitled to help with your mortgage just the same as anyone else who claims. However if you are over the limit by 30 pounds then the amount allowable on the mortgage will be reduced by 30 pounds.

    The calculation is:

    personal allowance (100.95 for couple) plus amount allowed for mortgage less part time earnings (after taking off 10 pound disregard)

    There is a 13 week qualifying period for help with mortgage. How long it will take to process depends on how busy the mortgage processing section is.

    A lot depends on this for us...
    The mortgage company have said providing i do get some/any help as we can not afford on one wage they will drop my mortgage to interest only this bring down payments and we could meet it..

    There is frequently misunderstanding about a situation like yours where there is no entitlement to JSA (IB) or IS due to excess income.
    Even staff in the JobCentre can give out incorrect information.
    However as long as you have claimed JSA (IB) and continue to sign on there is no reason why you should not get help with your mortgage (less 30 pounds as stated above). This is as long as you fulfill the required criteria. ie mortgage used to purchase property in which you live and any home loans used for 'allowable' home improvements.

    I do not give benefits advice unless I am 99% sure that I am right. I know how much upset and loss of income can be caused by being given the wrong advice.

    Thank you Deb this is getting on top now we feel...
    · 9th Sept 2008 - I First applied for Jobseekers Allowance online.

    · I received a telephone call to book and confirm my appointment and that I would have to attend a two tier interview, and was requested to take along my partners payslip, my mortgage details and my secured loan details.

    · 17th Sept 2008 - I had a face to face appointment at the Job Centre.

    · At the first stage interview my advisor started to go through my information which I had previously submitted online, at no stage did the advisor request my mortgage details, my partner’s payslip or my secured loan details. He only informed me that I would not receive any benefits as my partner worked. I was not allowed to go forward with phase 2 of the interview on these grounds. I could not believe what I was being told. I asked this to be confirmed again, the advisor confirmed that I would not receive any benefits and that I would not be able to go to phase 2, so I left and went home.

    · All these details are logged on my file on the Job Centres internal system.

    · I continued to struggle on to try and find a way to pay my mortgage, household bills and eat.

    · Unfortunately I was unable to pay my mortgage or household bills and found myself getting in a situation that was getting out of control with the prospect of losing my home, and the threat of being committed to prison for non payment of council tax, even though I had tried to get help from the Job Centre but to no avail. I contacted Community Legal Advise to see if there was any assistance they could give me in my dire situation.

    · Whilst all this was going on I received a letter from the County Court stating that I would be evicted from my home on 13th January 2009 at 8am for non payment of my mortgage. I immediately submitted a N244 form to request an emergency hearing, which was to be held on 9th Jan 2009 to try and stop my mortgage company repossessing my home.

    · 9th Jan 2009 – Court Hearing – I and my partner attended Court and the repossession was suspended pending a review in 3 months time providing I met the CMP of £864 plus £136 towards my arrears, totalling £1000.

    · I came away from court wondering how we were going to keep up with the payments as I was receiving no help from the Job Centre and my partners wage would not even cover half of the payment, we had exhausted goodwill gestures from friends and family so I decided to go back to the Job Centre as I was desperate to try and resolve some of the situation.

    · 16th Feb 2009 – I went down to the Job Centre to try once again to see if I could claim any benefits. I managed this time to get to phase 2 and was told that my claim would have to be processed and that I would find out in due course as to my entitlement.

    · 10th March 2009 – Another Court Hearing – I attended Magistrates Court for a Committal to prison hearing about non payment of Council tax. By this time I was finding the whole situation very stressful and now not only was my home hanging in the balance but now faced with the prospect of having to go to prison. Fortunately I appealed to the Judges better nature and due to the economic climate he decided that I could repay my arrears at an affordable sum and that I would not have to go to prison.

    At this point I still did not know if I was going to be able to pay my Council Tax for the new tax year starting in April. When I arrived home from Court that morning I had received a letter in the post stating that I was eligible for Council tax Benefits which came as a relief but still left me wondering as to other benefits and how I was going to eat that week.

    30th March 2009 – Another Court Hearing – Once again I attended County Court for a review of my repossession order. By the skin of my teeth I managed to get the order suspended again as we had paid 2 months mortgage and arrears but still have no idea how we will continue to pay so this situation is still looming and the prospect of me losing my home is unfortunately a very real situation.

    Todate : Housing cost form completed and returned from both mortgage and loan company.

    Loan company have now set a eviction date for May 12th i have completed form for hearing next week, before eviction to have a time order set and stop eviction.

    Mortgage company are sitting back to see if i get housing cost award ( will not wait for ever)

    Have said if i do get help they will change over my mortgage to interest only and that will help us out..

    Housing cost department you can not phone they have to phone you..
    I just need to know if or how or when we may get help...

    This could will also help at the hearing nxt week..

    I have also completed a JSA5 Form for back date of claim for being told i would get no help at the time...

    Even by this i have out run my 13 weeks i hope...
    But as we sit above the stated figure by £30pw
    like today i still had to pay the court £35 for the hearing..
    Basic if housing cost say no we lose our home to either loan company or mortgage.

    Sorry you are having such a bad time.
    It is really hard work having to struggle with all the bureaucracy, but you do seem to be dealing with things.

    I assume from what you have posted that you have completed the MI12 form/s for your mortgage and loan. Have they been received at the Jobcentre?

    They may need more information regarding your mortgage or/and loan before they can process them.

    If you have a remortgage they will need to know the original amount used to purchase the property and what the remortgage was for.
    For the loan they will need to know what the loan was spent on. A full breakdown including receipts. It is a good idea to ask them to process the mortgage without waiting for information on the loan if possible.

    Sorry it is late at night for me and I am writing this quickly. Hope it makes sense.

    13 weeks as of Jan this year. I am so sorry to read about your problems. We have had two close calls with abbey asking for a repossession hearing and I know how frightening it can be. Since then they have been far more supportive and providing I keep the current payments up (which thankfully have dropped from almost £700 per month down to just over £400 due to interest rates falling) plus £50 towards arrears they are holding off-they are charging no interest on the arrears. In fact they have just offered me the option of adding the arrears to my mortgage as I have kept up payments for 6 months but I have declined as the arrears will then incur interest again. I do hope you can get some help now-it makes no sense whatsover to me for people to lose their homes and then have to find accomodation in the private sector.
    Tomorrow is always fresh, with no mistakes in it!

    They keep saying my case is 39 weeks as an old claim and not in reciept of benefit as our award is nil makes the factor that we get no help till Nov 09 we must serve 39 weeks from the date in Feb...
    Two days ago on their screen it said 18th May now today it say's Nov...
    I don't think they really know.....
