After a very long and angry phone call being passed to, and this is no joke, 7 different departments, i finally got through to the right one who just told me to send a new letter in as it was obviously lost and there was nothing more they could do. I asked to speak to the manager and she said the same thing until i told her id reported them already for failure to give the correct info out in the time frame and that i would make another formal complaint etc and basically cause mary hell until i got what i wanted (all said in my best professional, dont mess with me voice) and funnily enough she started taking me seriously. Put me on hold while she spoke to the mail room, created a complaint file and gave me the right reference numbers and told me to resend the letter and quote reference so it would be treated with urgency etc. Anyways, i was happy with that, but what should land on my doormat two days later? A statement with all the charges etc that i needed :-) . And they havent even cashed the cheque cos i stopped it as they advised so it just shows you that they need a kick up the bum and to be spoken fimrly too otherwise they will try every trick in the book to ignore you.
Anyways, claim letter number 1 (with interest if you please for my troubles :-) ) is on its way, recorded mail first thing tuesday morning. Will keep you updated.Thinking it over...:o0 -

I am seriously hitting a brick wall here. When i ring to chase it up, im getting told that my complaint is on hold and they havent considered me under hardship rules and then im being told they sent my financial statement to the collections department?? I ring the collections department and they have no idea what im talking about!! Then i get told that there is no telephone line to speak to someone who may have an idea what is going on, so what do i do?
Send a letter in? But to what address? The last one i had back from them was the 'customer service recovery centre' in Andover. Shall i send it to them?Thinking it over...:o0 -
LOL - this is common knowledge that Lloyds will mess everyone about from day 1, everyone who tries to claim will be passed from pillar to post like you are, i tell you your not the only one whos had this off them you should read the Lloyds threads in this section more - least you know for yourself now and maybe advise others what Lloyds will do under hardship claims.
DON'T send to Andover they will give you a load of jargon and say they have passed your claim to customer services, instead save yourself a lot of hassle and go to the FOS, fill in a expenses form and leave it with them because you won't get nowhere with hardship claims if you don't, all the B.S. will continue.Owed out = lots. :cool:0 -
Sorry can i pick your brain again? Iv now been told that regardless of whether my claim is under financial hardship of not, they are saying that all claims are on hold. I didnt know this was right? Is it?Thinking it over...:o0

No this is not right. The FSA have told banks that if people are claiming financial hardship then they must deal with the claim straight away (This does not mean they must refund the charges though).

If you go to the FOS then the minimum timeframe you have is 12 weeks. Without a final response from LloydsTSB in writing then it could be longer. OK, what you need to do is to send copies to the FOS these things:complaint made to FOS :-)
Correspondence between you and the bank,
A schedule of charges,

any priority debt arrears notices,
how your hardship began, since the bank charge is a consequence of having insufficient funds on your account so there must be a reason why you overspent/used the money previously sufficient to live on,
Furthermore you need to explain how the charges hit into your ability to service or pay the priority debt arrears.
Finally, you need to have an outcome in your mind. If your only outcome is 100% charges then you will be very disappointed. Think about the priority debt arrears and any unauthorised overdraft that is on the account. Perhaps an idea is that the refund is for the priority debt arrears and the overdraft extended to avoid further charges while you are able to sort out budgetting again.
Something of that nature which does not have to be 100% of the charges, Remember that those charges not refunded will still be on the table once any final solution to the OFT test case is known0
