iPhone falling apart - O2 say its wear and tear!!!

I took my iphone out of my pocket on Saturday and notice that the volume button on the side has fallen off! I don't know where it is or how it happened! Anyway, I got the upgrade in Jan so I rang O2 only to be told that its classed as wear and tear even though its only 3 months old.
Have I got an arguement here? I can see their point of view in that it could be accidental damage, but I genuinely haven't dropped it or anything. I don't want to have to pay to get a new button fitted, does anyone have any advice?

Yes you do!
The silent button fell off the side of my iPhone a few months into getting it and I took it to an Apple store and they replaced it there and then. O2 are just fobbing you off.0 -
So if I take it back to an Apple store they should either repair or replace it?0
