Well as much as i know roundabouts are somewhat no-mans lands im hoping the fact that it happened on the slip road off the roundabout helps my case somewhat, it's not like i cut her up on the roundabout.
I'd come off the roundabout, she came off behind me, i stopped in the que of traffic she did not... luckily she can't even try the "changing lanes" story as there are roadworks all along that slip road and there was no other lane for me to be in.
Thing is she gave me her details but wouldn't take mine which is just weird... i mean seriously at this point in time she can't even put in a claim against me as she doens't know who i am ?? and won't know till the bill arrives with her insurance people.
I was in exactly the same position, you know just coming off a roundabout, but admittedly I wasn't rear ended but had the corner of my car clipped. I thought it was a clear cut case of the other party hitting my car, but the toe rag insisted it was my fault and I got no support from my insurer(drrr, wonder why), so I ended up with a 50/50 and loss of my no claims bonus. Like the previous poster stated, a camera phone is handy - but a witness is extremely useful. Good luck whatever happens.Most people are working too hard to make really decent money:eek:0 -
Well i've phoned the police and given them the details of the situation the woman on the phone was very helpful, at least it's recorded now that i did try and give my details across although i can't prove it, there would be very little point in me ... telling my insurance company about the accident, telling the police about the accident but strangly withholding my details from her...
She has no excuse for not grabbing a pen and paper and writing down my registation at the very very least, i got her's, her name and her phone number and took a couple of photo's of the damage to both cars (though i didn't take photo's of the postion of cars as we drove up onto the verge to get out of the way of other traffic) so if i had time to do all that she surely could have written down my reg??
Anyway i can't see a rational for why a person would give out details to someone who refused to give them?? so i wouldn't imagine she'd have a very strong case if that was her thinking.

Looking at this from the third party's (ignorant) pov, it could possibly just be that she accepts the accident was her fault, so has no need for your details, as she feels she has no use for them.0

You might need to prove from photographs that there was only one lane open at the time, and that you can show that you could not, and did not, cause the accident by changing lanes without signalling (or whatever else might be argued at a later date..)

i see from the local rag that a specialist operations CID unit of 13 detectives is now battling against a "credit-crunch crime spree" of fraudulent insurance claims....
As if to serve as a deterrent to other would-be fraudsters, the halfwits at the local newspaper report on the story of a wannabe fraudster who told detectives that he had £20,000 of property stolen in a burglary. However, during interview he admitted that he had made up the entire story for his insurance claim... he was ordered to pay a fixed penalty notice of................£80.
What on earth is going on? If £80 is the sum total of the stake at risk, then for many people, it's surely worth the gamble when the prize is £20,000!
And there was silly old me, thinking that the punishment is meant to fit the crime!0 -

Sorry to hear you have been made redundant, I got made redundant in January and am still really upset over it. Hopefully things will get better for you.
The fact the person is being so difficult is a cause for concern, she is obviously trying to wriggle out of her responsibilities.
Just ensure that you get your insurers to deal with this woman via her insurers, don't phone her or her husband, you can do without the upset. Make sure you get your facts straight when talking to your insurers and they should get all your repairs done and paid for by the third party insurer.
Don't delay getting your insurers to deal with the accident as this woman is looking for excuses as to how the accident happened and could try and turn around and say you reversed into her (this has happened before). Make sure you are provided with a courtesy car whilst your vehicle is being repaired. The fact your vehicle is a little old has no bearing on the claim.
This woman obviously is a negligent driver, in your case you appear to have suffered no injury, luckily, the next time she could kill or seriously hurt someone.
If you do not pursue the repairs she will not be held accountable for the damage she is doing driving in this manner, and with her attitude she clearly does not feel any remorse.

The woman is upset and not thinking straight.
She's probably in real deep s**t now financially.
She probably doesn't have a materplan but is upset, possibly in shock and not thinking straight.
Don't credit her with ingenuinty. She's just panicking and proabbly is quite shocked about what happened and is thinking "what if" (child, old lady etc.)
I had a near miss on my motorbike a few days ago.
There was no collision, but believe me it grabs your attention and that was without any crash.0 -
