Limo Broker - limo didn't arrive!

Hi All, I'm new here just hoped someone could give me some advice!
Had a limo booked with Limobroker.co.uk - a range rover stretch limo for my brother's 18th birthday last night.
Basically it never arrived! Spoke to the guy who was on the end of the phone called Justin claiming to be the manager - who was really unhelpful - saying it as stuck on traffic on the M3 and hadn't moved for 40 mins (has a tracker apparently!) Anyway after several desperate phone calls to him he just couldnt give us any answers and was unwilling to explain himself!
We had only paid a £50 deposit adn the remaining £325 was due to the driver on collection.
However I am furious - we had to get 16 people ferried into town by taxi all at a cost and also we missed our VIP booking at a club which left me £350 out of pocket!
I told him we would be taking this further - but what can I do? Is trading standards an option? Small claims court?
Any advice much appreciated! They shouldn't be allowed to get away with it!
(The fact that my friends had just driven down the exact part of the M3 that he said it was stuck on and hadn't caught any traffic and on asking him if perhaps it could just collect us at 1am he said it wasn't possible - so it's all fishy!)

Trading standards won;t help, so if you want persue it I'd issue a small claims court writ, or pay a solicitor to write a letter for you.

You're entitled to your deposit back. Anything else would be a gesture from the company.

    Again, rubbish.

Clearly this was a contract for enjoyment. You are entitled to the very rare English law claim of damages for disappointment.

Jackson -v- Horizon Holidays is the leading case on this point.

Basically, you contracted for something which was supposed to give pleasure. Like a holiday. You didn't receive that and so the law takes the view that you should be compensated for that.
  • Nonsense.

Their breach of contract has cost you x amount, you are entitled to retrieve that amount from them.

You can reclaim the deposit + missed event. You could probably add the taxi fees although to be fair you would have had transport expenses no matter what, so you'd have to see how that would have compared with the cost of the limo. You can also add something as compensation for the disappointment/embarassment their failure to adhere to the contract has caused you and your party.

Send a letter detailing your grievance, giving them 14 days to respond appropriately. If that fails, a letter before action giving them a further 14 days. At the end of the 14 days, sue them. Don't bother threatening them with SCC if you're not willing to go through with it. Go to CAG if you need help with drafting the claim form.
  • Ooops, typing at the same time. "Nonsense" wasn't addressed to you, Tozer, I hope you realised. :)
