    The people who reply to my thanked posts are from people with genuine thanks who are appreciative of the help and advice when given, where as yours the majority are just from a small clique group who just want to thank each other for the sake of it and pat each other on the back !.Having said that to reiterate, all of your contributions of advice on this forum are appreciated even by me. I was quite willing to end this but was totally offended by your Garry Anderson comment !

    So you have the right to accuse others of being sycophants but when its thrown back at you its an insult. There is a lesson in there somewhere.

    This is how i would look at the above as a DM for HB/CTB in the above case.

    I would want to know the following:

    1. Was the customer aware of the rules regarding the capital limits for HB/CTB ? In this case it is a yes.
    2. Were the debts priority debts - mortgage arrears, council tax, utility bills etc ( as alwaysonthego has mentioned). If this was the case then i would not see this as deprivation of capital, but i would expect to see proof of this.
    3. If they were credit card debts had the customer been threatened with any action e.g Letters etc again would need proof.
    4. Were debt repayments causing hardship i.e monthly debt repayments were very high in comaprison with income.

    Basically the main things i would want to know would be if the debts needed to be repaid now and how much knowledge the customer has regarding the capital limits.

    But each case is different, but from my experience cases where capital has been reduced significantly just before making a claim are always looked at a little more closely.

    In all cases i would expect to be able to see proof that debts had been repaid e.g bills, statments etc. In the case of family loans i would want if possible a statement to confim the amount paid etc.
