Bought used car 2 weeks ago, clutch pedal snapped,Whats my legal right?

Hi,

so today the car broke down on the road. I have it 10 days. 52 reg . The pin in the clutch pedal snapped. Paid £2,800 to an independent dealer. It had full service history and 2 owners and was 90,000 miles. Very good nick to look at. Did a test drive etc and basic checks. Today AA towed me to a local garage . I will know costs tomorrow and if the whole clutch needs replacing. (I got a years warranty privately but it excludes first 90 days.)

Should I phone the dealer tomorrow? What approach with him? Have I a right to expect a repair here?

    Was it a Peugeot by any chance?

    You have to give the selling dealer a few attempts at fixing the car under the SOG act.

    It was a ford focus. So do I inform the dealer then before any repair? I'll happily give him a chance, just wondering about the law.

  • Ideally the car should of been towed to the supplying dealer for them to sort out in their own workshop. Best ring them tomo morning, explain the situation and politely explain that you would like them to meet the costs since you only bought it 10days ago. See what they say to that.
    They should really repair it or pay to have it repaired FOC under SOGA.

    It'll be a new clutch cable at worst. :rolleyes:

    Got the costs now from local garage- £467!!!!!!!!!

    The clutch master cylinder, clutch and clutch bearing are bust.

    Am contacting the dealer I bought from now- this can't be right under the SOGA

    £537 inc VAT???

    No -that's what AA man said too -and now the local garage say it also

    Dealer says he'll go 50/50. I say no. He offers to do for 450. I pay 150?

    I don't think that's reasonable -is it?
