  • I work for a company that is paid by the local council to support vulnerable people. Cuts were announced months before the government cuts but we were instructed not to tell the clients, or anyone else, under threat of early redundancy. Is this allowed?? We were told back in June that the contract would end in March 2011 and we would be made redundant then.

    Now the cuts have been anounced, people are beginning to ask how the service will be affected, and I'm finding it hard to know what to say. We have been told several times in the last couple of months that letters will be sent out to everyone soon, but no sign of anything yet. We were told last month that we would be given our formal 3 month notice in November but now we've heard that isn't very likely.

    We keep hearing lots of rumours about what's going on but nothing is ever told us directly. All of us "lowly" workers feel we're being treated really badly and we're not sure of our rights. We keep hearing hints that the company might be able to get funding, so because none of us really know what's going on we don't know how hard we should really be trying to look for other jobs.

    I'm applying for jobs everyday but haven't managed to get an interview yet. What do people think?
  • I am an employer and sadly the time has come to shut up shop before we loose everything.
    We have 4 employees including myself,
    One of them however has started going on about holiday pay due, the internet is not very clear on how much would be paid etc.
    They have been working for us for about 6 years.
    ANy help would be great.
  • I work for a very small company who have employed a consultant to undertake a review and come up with a restructuring. My job title has completed disappeared but is replaced by two jobs with a similar role, at about two thirds of my salary. I cannot be assimilated as the pay is vastly different, there is only me that currently does the role I do. The work content is broadly similar, but there is a loss of the management of three of the six staff I currently manage.

    I can apply for the new role apparently under ring fencing. Does this mean I have to take the reduced salary. There is also a plan to introduce new contracts because they want to introduce performance monitoring and to get away from NJC pay scales. Do I have to sign, and is that the way they force me to take less money.

    Hi sorry about this but i'm having problems posting a new thred - it returns me to the login page all the time so i cant post a new thread and need some help because my problem is making me feel ill with worry

    I worked for a company for 5 years and got a new job, the new job had a 3 month probation period which I have passed but because my former employer of 5 years will not give a reference I will lose the job.

    The former employer
    ..Promised a reference verbally
    ..Has told my new employer that he would 'do it today' on several occassions
    ..has not responded to any of 10 written requests for a reference from my new employer because 'he never received them' at the business address
    ..Has sent me texts saying he 'would do it today' on several occassions as well as 'its done and sent'

    Can I take them to a tribuneral?

    Please can a mod make this a new thread because i'm unable to :(

    Redundancy is paid after you have been employed for 2 years or more by the same employer. You are entitled to one week's statutory pay between 22-41 years old and over 41 years old you get 1.5 weeks statutory pay. I think at the moment this is around £390 but not sure. You also get your notice period pay ie one month. This is tax free.

    If you want to leave before the date given for your redundancy you can take any holiday entitlement. Any holiday entitlement not taken and accrued - you get paid for.

    If you have worked under 2 years, you get your notice pay plus any holiday entitlement accrued.

    Hope this helps people.

    You are only talking about statutory redundancy, the company you work for may have their own discretionary redundancy package in addition. And with regard to the tax free notice period pay- its not just notice period pay, if your total redundancy payout is toes £30,000 then it is tax free.

    Firstly sorry if this post is in the wrong place I'm a bit confused as to where I post my questions so here it is.

    The business I work has gone bankrupt, or rather will be in the next week or so. I am still owed wages - a month and a half approx £1500- but have only been with the company for 11 months. My boss has assured us that paying staff is his prime concern. The business is small a furniture shop, we are still trading until the bankruptcy is official, and this is how our boss intends to pay us. I have my doubts this will happen at all.

    From what I've been reading it doesn't look as though I will entitled to anything via the government as I have only been working there 11 months. What should I be doing? My concern is obviously that I won't get paid. Should I take some stock in lieu of payment? Can I sign on now?

    Please any advice would be much appreciated.

  • I wonder if you could give me some advise. I have been working for an employer for 4 years - my hours have changed over the years but for 2 of those years I was full time.
    The latter part of my employment was only part time as the business was in trouble. I have now been made redundant and given my redundancy by cheque.

    Firstly could somebody confirm that by cashing the cheque am I accepting the amount to be correct.

    And secondly I have been paid my 4 years of redundancy as if I was only part time for all of those years (I have never had a written contract). I am guessing this is wrong but I am not sure.

  • My Husband is about to be made redundant from his place of work very shortly, he has been with the for 9 years full time and he is 53 years old. Can anyone tell me what he is entitled to and also does he automatically receive his redundancy pay in his last monthly pay. Thanks in advance x
  • I'm posting this as a warning to anyone out there who is about to be made redundant or has been made redundant by a company or individual who has no money. If your employer has not been declared insolvent you will have difficulty obtaining actual pay due to you. The insolvency service only pay redundancy payments if your employer is not insolvent NOT arrears of pay. My firm closed last December. My colleague and I were told by our boss that he would be insolvent and we could add our last two and a half weeks arrears of pay to our insolvency claim. He did not make himself insolvent. The bank havent and neither have his other creditors. We have had to take him to an employment tribunal to have a pay award. He hasn't paid. We have filed the award with the High Court using a fast track procedure but the bailiffs haven't recovered anything from him and he has managed to stop them enforcing the Order. He has managed to have the matter heard by a court who failed to give us notice of the hearing and allowed to repay us at miserly amounts of just over £20 per month which will take over four years to pay. There appears to be nothing we can do about this. So the £800 I was due in pay arrears last Christmas I have to wait 4 1/2 years for and thats supposine he continues to make the payments (the first was late) - the Court haven't even sent a breakdown to show whether interest is being added and will not reply to letters, telephone calls or emails so watch out everyone out there in this position. To add insult to injury guess our employment - yes A SOLICITORS OFFICE.
