buying phone off ebay. what if contract?

My mate cant be convinced into going for a cashback deal and is looking to buy a phone from ebay. Not too sure what sort but what i would like to know is what if the phone he gets is one that someone has got on a contract and then they dont pay it every month? Will the phone get cut off?

Im sure that there are plenty on ebay that are sold as unwanted upgrades and so on or people just profiting from the cashback contracts and selling the phones on. I dont blame them for doing that but am a little concerned that if my mate goes and buys one he may have it a month or so and then have no use of it.

Does anyone know if this could happen?

    only if the seller reports the phone as stolen

    it's perfectly legal to sell an upgrade phone , the contract is on the sim card ;)

    With orange they bar the phone for non-payment (wrong through.)

    Most phones that sell on ebay are legit phones that people sell on for the cash. I have bought and sold many upgraded phones on ebay most recently i bought a Samsung Z320i just 2 days ago. Just make sure you buy from a seller that has very good feedback. The seller could always report the phone lost or stolen after they sell it so thats why i say buy from a trusted seller with HIGH POSTIVE FEEDBACK.

    So going from what iceburn says it would be safer to stick to any network apart from orange?
