lodger, off work, wont go back and on about claiming housing benefit??

    Depression is an illness. Would you be this judgmental if your friend had a broken leg, or cancer? "If she just went back to work ..." - that's basically saying there's nothing wrong with her. And others here appear to agree with this. No wonder charities have a uphill battle explaining that mental illnes is real.

    I can appreciate you're worried about money but from what you say she has actually borrowed from elsewhere so that you don't lose out. How about a bit of compassion? Or perhaps wait until HB causes a problem, and not just assuming that it will. In her current state, she's not going to find it easy to find an alternative - or are you not really a friend at all?

    how very kind you all are ..
    someone is ill ...and you all want to kick her out on the street with just five days notice when she obvioulsy has no money and is going to struggle to find money .

    Forget wether she could work or not besides the fact none of us know her exact situation/diagnosis etc its not up to us as individuals to decide if she would be better off in work or what

    this person could claim lha without you knowing and pay it too you on time everymonth .
    why wont you put her on the tenancy ?
    does your landlord know she lives there?
    whats her opinion?


    i do hope that you dont ever find yourself in a similar situation!

    I agree I wouldnt kick a friend with depression out, but thats not what the OP was asking....she wasnt asking for a moral judgement, she was asking what rights the lodger had, quite simply not many.
    If she is suffering from depression, kicking her out of her home, is not going to help her.

  • Your lodger cannot claim housing benefit without proof of a tenancy ie. a tenancy agreement. As she doesn't have one she won't be able to claim.

    This will incur costs for a new tenancy and also credit checks (which she is unlikely to past) plus will give her lots of rights to stay and tie the OP to her financially. The LL obviously tolerates subletting but doesn't want it on an official footing. If the LL let the second person on the contract this is pushing it into HMO territory and the associated legislation - two people with other people living there on a contract. Many mortgage companies forbid LLs letting to LHA claimants and that would show up at credit check and the LL may well not want break their contract there.

    If you really don't want her there then help her find somewhere else don't just kick her out or why not do something really nice and let her stay..its good to help people !

    We don't know anything about this woman's position she could have a whole heap of family/friends locally who could accommodate her - which the OP may well know.

    Not all those pertaining to suffer from depression do and perhaps she is exagerating it and perhaps the OP knows her well enough and for long enough or she has said something.....

    again - we don't know and the OP does and hopefully can pick up the elements that are relevent.

    I think the OP is subsidising this woman and even paying for her food and is saying she can't financially afford to subsidise a housing benefit claim if it takes a long time. Moreover it isn't a a case of just letting her stay she may have to change her own tenancy, enter negotiations with the LL, change the nature of the contract in order to accommodate this.

    I have a lodger, no formal tenancy, she pays £300 a month for a double room all in, just has to provide SOME food, most is included as I buy the basics for us all, there are 4 of us, me and 3 lodgers. She has been off work on sick since last Oct, and is now down to SSP, she got into arrears but she has now borrowed the money to bring this back up to date, and she said she was going back to work, after all she had no choice! Now, she is saying that the doctor is not allowing her back to work yet (stress and depression) and that she can claim income support and housing benefit, now, I am sub letting, with my landlady's permission, so each month when she was in arrears, I was footing her bill, as I am responsible for paying the rent, and I am not prepared to accept housing benefits, even if they would do this with no tenancy in place, and I am not putting her on the tenancy, but even if she was on, my landlady would not accept benefits, sorry if this waffles a bit, bare with me, now, my question is, CAN I BE MADE TO ACCEPT HOUSING BENEFIT? I am seriously considering just asking her to leave, I cant be doing with it all.

    The LL may not accept housing benefit because the mortgage on a BTL forbids letting to LHA/HB claimants. In trying to accommodate this woman some posters may be asking the OP or the LL to break their legally binding contracts.
