    the one you destroyed was covered by warranty and prob a 3 year brakedown service.... so buying a 2nd hand one and leaving it with her would leave her a little disadvnataged imo.

    Still dont get why she didnt claim on insurance,

    You can try to get a new one discounted at the Comet auction website.

    Or try the "I want one" (or similar name) board here, giving the name/model you might even get one cheaper than she ever paid.

    Yes you are right - it did have a three year breakdown cover and she has lost that - it is non transferrable. However she has said that she will purchase a new one and doesn't expect us to. I have to reiterate what a lovely LL she is, I am not trying to do her out of anything, I am just trying to get the best for both of us bearing in mind I have no money and I am having to borrow the money to buy a replacement.

    The cooker was £178 and her insurance excess is £100, so she felt it wasn't worth it. She said she would also lose £35 no claims bonus.

    So as we caused the damage we are trying to help her by buying a replacement to save her claiming.

    A like for like replacement would now be about £190, but because we felt that the combined oven and grill contributed to the fire, we want to slightly upgrade and that costs £215 (which I realise is our choice).

    I could claim on my insurance, which I believe covers LL stuff, but my excess is also £100 and then my premiums will probably go up next year because I am already in the middle of claiming for a broken settee (yes it has been a bad month for us!)

    eBay is no good due to the lack of warranty.

    No idea re comet/warranty

    eBay doesn't mean lack of warranty. Maybe somebody bought one (with warranty) and changed their mind. Maybe somebody bought on e, fell out with their other half and took it with them but don't need it. Maybe they're dealers. eBay isn't all private sellers.

    No, but our landlord wants to purchase a three year one, which is unlikely on eBay, if not impossible.

    If I can also add, as this is a gas appliance it needs to be installed by a Gas Safe engineer (previously corgi). I don't believe that even new cookers are excluded from being added onto a CP12 gas safety certificate? If I am correct a Gas Safe engineer will have to issue a safety certificate on it.

    As a landlord I would not accept a second hand cooker. I realise this is not going ahead now but as a landlord you have responsbility for the safety of appliances and a second hand gas cooker would not be acceptable to me.

    I assume this cooker will now belong to the landlady. I would expect that the inventory is amended and that whatever arrangement you have agreed to in formalised in writing. This will save any issues further down the line when the deposit is dealt with.

    Yes I have already put in writing that the cooker will stay here should we move out.

    At the risk of being shouted down though, I still feel I am losing out somewhere because I am spending over £200 on something that will not belong to me (although I realise it was an accident and I am not saying the LL should pay for it either, I just feel something is not quite right!)

    At the end of the day, you are wanting the upgrade not the landlady. I am sure millions of people have the same oven/grill as you had. Saying that though if it really is a better model then, as your landlady sounds like a reasonable individual she may be open to making a contribution. She isn't obliged to as she has supplied you previously with a perfectly good cooker beforehand.

    She may be more willing the make a contribution at the end of the tenancy if you were to leave it in brand new condition i.e immaculate. (Cookers are often a bone of contention between landlord and tenant). You could try and make an agreement to this effect - it would more than likely still be almost be a gentleman's agreement as it wouldn't be worth court action over the amount even if in writing. However, don't push your luck. You do need to agree though who is paying for the installation and gas cert - this will cost money! It's a very long time since I installed a gas cooker so I do hope I am correct in my information about the gas cert etc.

    Your landlady sounds to have been very reasonable and professional indeed - what I would hope and expect but nevertheless you could be having a much bigger battle on your hands right now with a less accommodating landlord.

    No shouting but your LL sounds very reasonable. You have admitted that your own actions/omissions caused the damage - it is clearly right and proper that you pay the costs for reinstating the LL's property one way or another.

    It's interesting that you commented on the fact that if you claimed on your own tenant insurance then your premiums would go up the following year, in addition to having to pay an excess, but you didn't seem to have registered that this too would the the case for the LL if she were to claim on her LL insurance. That said, she can set such costs against rental income for tax purposes.......;)

    However, I'm always amazed by LLs who don't provide basic smoke alarms, fire blanket and fire extinguishers, under their basic "duty of care" to their T and to limit the potential of more extensive damage incircumstances such as yours.
