Excess - Us or landlady?

yet you also want to wriggle out of paying for her excess ?
The OP has clearly put that she has offered to pay the excess in installments, so how is that wriggling out of anything?
The question was whether or not she legally had to pay it, not whether or not you thought she should or not.
And saying 'you set fire' to the kitchen is hardly fair, fires are horrible things to go through so it's very unlikely it was done on purpose."There is no medicine like hope, no incentive so great, and no tonic so powerful as expectation of something better tomorrow." - Orison Swett Marden0 -
Of course it wasnt done maliciously, but none the less the OP damaged the LL property, and of course she has now said she will pay albeit in instalments. But the whole point of the thread to be fair was to try and see if she could get away without paying it, which is pretty unreasonable, considering she caused the damage.
When one crashes a car, one doesnt do it intentionally but you still have to pay your insurance excess, and the insurance company claims off the person who is at fault, thats why we have insurance. Considering the damage, I think a £200 excess is very fair, and by the OP own admission the LL is a fair and good one.Pawpurrs x

Yes, but my point was she had already said yeah, you're right, I'll try and find the money to pay, and people are still replying almost attacking her. That is what I found unfair."There is no medicine like hope, no incentive so great, and no tonic so powerful as expectation of something better tomorrow." - Orison Swett Marden0

I am most certainly not attacking her, sorry if it appears that way. I think people were a bit suprised that she thought she shouldnt pay for some reason.
As you are related to the OP I guess she must feel attacked......sorry you feel that way OP.Pawpurrs x

if you come to a public forum you will get a wide range of opinions - you may not like some of them
we are reacting to the situation you present - not the person - we dont know him/her from adam
dont take offence !!0 -
It's not that we've taken offense or don't agree, I was just commenting on the fact the OP had said fair enough, I'll pay, and people were still replying as if she was refusing to."There is no medicine like hope, no incentive so great, and no tonic so powerful as expectation of something better tomorrow." - Orison Swett Marden0

Oops I did not mean to make it sound like I was wriggling out of paying.
I think I was just panicking about the money - as I said if I had it I would have offered it to her straight away.
I don't think I worded the questions correctly in the first place, what I meant was - Is it usual for the tenant to pay the excess or is it something the landlady would pay as that is a risk you take with having tenants.
Since first posting, I have come up with a way of offering to pay it (in instalments) so hopefully that should solve it.

No problem, I know just how difficult it is at the moment for a lot of people, I hope the LL will be happy with that she sounds like a nice reasonable LL. On the bright side you will get a nice new cooker. At least the fire wasnt too serious and nobody was hurt thats the main thing, accidents can happen to anyone.
It can be difficult to Get things across on a forum, and I dont think any one meant any harm.Pawpurrs x

i am glad you have found a solution
""Is it usual for the tenant to pay the excess or is it something the landlady would pay as that is a risk you take with having tenants.""
this is a grey area - my point was that as you had caused the damage, you should pay for it, and part of the cost the LL will have incurred due to your actions includes the excess
by law tho - you as tenant need to return the property to the LL in the same condition as you moved in (less fair wear and tear) - and a more unscrupulous landlord could have charged you a great deal for redecoration, skips, new kitchen units, new flooring, new cooker etc etc
its good you have found a compromise way forward0 -
Be nice people! Never jump in to conclusions. And always try to be as nice as poss in your replies coz you never know the full story (unless the person is being an ar**, then its understandable.)
Don't lose the love guys and girlies - you can express individual opinions and still be nice! xMummy of 3 lovely munchkins :smileyhea0
