OSPS - Changing tariff ?

Newbie here so hello all,
Have had two contracts from them in the past and aside form a longer
than desirable delay in one cashback I have not had any problems that
would stop me at least considering another.
Looking at their current T&C's I could not find anything obvious with
regard to changing of tarrif within a specified period. On my last
Orange deal it was quite clear that I should remain on my chosen tariff
for 6 months. I did change after that without any problems.
It would seem from the quoted text below that they are now
saying/suggesting if you change within 12 months (assuming thats the
minimum term) you won't get paid out ? It doesn't make specific
reference to Cashback payments though.
Just wondered if anybody who has recently taken out a OSPS deal might be
able to confirm what is stated on the order confirmation/T&C's supplied
?

These are their current terms and conditions, which seems to imply no movement of tariff for at least six months from commencement:
If you enter a nominated airtime contract and subsequently move onto a lower tariff or fail to fulfil your payment obligations during the minimum term of such contract, or you end such contract for any reason within 6 months of the commencement date and the relevant tariff includes a subsidised handset, you must, in addition to paying any other charges under such contract, either:
- return the Mobile Phone to us by sending it special delivery to online Returns, CPW Logistics Centre, Bilston Road, Wednesbury, West Midlands, WS10 7JN at the same time as giving us notice that you wish to end such contract; or
- keep the Mobile Phone, in which case you agree to pay us the handset-only retail price (up to £400) being the purchase price (the "Purchase Price") of the Mobile Phone and you hereby authorise us to take the relevant Purchase Price from your nominated credit or debit card or through such other means as we may require in the event that the Mobile Phone is not returned to us in accordance with Clause 3.6.1 above.0 -

Thats what I have been reading but I seem to read it slghtly differently and these T&C's are different to my last contact from them - since becoming part of CPW.
My last Cashback from them quite clearly said I was free to change tariff after 6 months (with Orange)Steve_xx wrote:If you enter a nominated airtime contract and subsequently move onto a lower tariff or fail to fulfil your payment obligations during the minimum term of such contract,
That seems to be referring to a change of tariff within 12 months (assuming a 12 month contract)Steve_xx wrote:or you end such contract for any reason within 6 months of the commencement date and the relevant tariff includes a subsidised handset, you must, in addition to paying any other charges under such contract, either:
The 6 months quoted seems to be to be specific as to ending a contract within 6 months.
Am I not seeing the sand because of the beach
Any confirmation from anybody with a recent cashback deal from OSPS of what is on the paperwork received would be appreciated.
Many thanks

you certainly used to be able to downgrade after 6 months (except for tmobile contracts) however they have now changed this ater discusions with the network and you can only upgrade the tariff after 6 months.0

1. It implies that you cannot change to a lower tariff during the minimum term, which will be either 12 or 18 months.
2. You must not fail to make payments due during the minimum term.
3. If you cancel the contract within 6 months of commencement it implies that you must pay all of the monthly rentals that you would have paid had you continued the contract to its natural conclusion. But they'll be kind and let you pay them all upfront in order to let you out of the contract.
and
You must return the subsidised handset to them.
or
keep the handset and let them take what they want, upto a maximum of £400 from your bank account.
So then it is probably the case that if you go beyond six months that the same charges will apply, ie all of the remainder of the minumum period of the contract would have to be paid, but you would not have to return the handset after the 6 month period was up.
How does that sound matey?0 -

We seem to be agreeing that with OSPS it appears you cannot change to a lower tariff during the minimum term of your contract - ie 12 months on a 12 month contract.
With my last OSPS deal and as Yaacov81 mentioned this was not the case in the past when you could change after 6 months without penalty. I now see that in their "Your Gift Explained" they say at the bottom:
Please Note
Free Gifts, Direct Credits and Cashbacks are subject to your handset
remaining connected on the network tariff you signed up for. If you have
any questions, please call 0845 456 7878. E&OE. Confirmation of your Free
Gifts, Direct Credits and Cashbacks will be printed on your invoice.
Their "sister" outfit e2save.com T&C's printed on the back of their invoice have the same T&C's - unsurprsing as they are all part of CPW but the T&C's on the e2save web site say:
8. Changing Price Plan
The pricing of a phone (and any associated offers inc. cashback/line rental) is dependent on a specific price plan being selected. If you subsequently change this price plan within the periods defined below then the purchase price variance for the phone, based on the price plan you have actually changed to, will be charged to your credit/debit card.
Periods during which "purchase price variance change of price plan charge" will apply:
T-Mobile 11 Months
Vodafone 9 Months
O2 6 Months
Orange 6 Months
3 6 Months
BT Mobile 6 Months
Virgin Mobile Duration of contract
In addition, any cashback/line rental offers will be reclaimed if these are not applicable to the price plan you have changed to. We therefore strongly advise that you do not change your price plan within the specified periods.

Yes, but your concern is with OSPS, not e2save's terms.
If, when you took out your contract with them the contract terms were different to what they are now, then those different terms will apply to your purchase. Any new purchases from OSPS will be subject to the current terms and conditions.0
