I found this site today and have learn alot already but
Could anyone shed some light on my problem.
Ive got a Basic Account with Abbey, Had about 3quid in there and a DD went in and out and got charged for it. Here is a cut'n'paste job
09 Mar 06 Charge for unpaid direct debit no 01 35.00 -31.93
09 Feb 06 Withdrawal from cash machine owned by Sainsbury's Bank 10.00 3.07
24 Jan 06 Direct Debit to NORWICH UNION DIRE not paid, as insufficient money in your account 52.38 13.07
24 Jan 06 Direct Debit no 01, to NORWICH UNION DIRE 52.38 -39.31
Being the forgetfull person i am , i forgot to cancel the debit.
Could anyone tell me if i able to claim that charge back seen as the charge doesnt exceed the debit?

Wether the charges relating to going overdrawn, or failed Direct debits, both of these are what is know as a punitive penaltie, which you can claim back
I say punative penalties, because that is what they are classed as by law, and by law those charges are unenforcable in court, because they dont reflect the banks true losses
RIng the bank up and demand the money back, explaining the above, ignore the "you signed up for T&C" they will try and fob you off with, and say you will be complaining in writing if they dont pay up.
Then follow it up as far as it goes0 -

I just rang up and said what you said and they refunded it. But the women said if it happens again in the nxt 12 months they wont be able to do it again.

They prob wont refund, then you will have to go through the courts.
either way congrats on getting your money back
Ive just had a call with a lovely lady on the halifax cc line about getting £120 quid back
She said someone from customer services will look into it0 -

Thanks for answering my question, I will get the ball rolling on monday for the court claim. I have already recieved a list of charges from them, put this in a spreadsheet listing what each charge was for - charges came to £651 :eek: also worked out the 8% interest which comes to £199.11. Now all I need to do is get on that website to make sure I phrase things properly and submit my claim. Will let you know how I get on.

I have paid the halifax loads over the years but i cant even get them to send me statements because my old account with them is linked in with my dmpso Im stuck.

Hi Pixie,
Can you not put in a complaint to the Information Commissioner? Not sure of the legalities if your in a DMP but surely you can have access to your own bank statements?
