Advice on my daughters debt please

After a failed relationship my daugters was left £25,000 in debt, her ex very cleverly put everything in her name! The majority of the debt is owed to the halifax, after getting into debt with them with her credit cards they persuaded my 22 yr old to take out a large colidsidation loan. Once my daugher came home I helped her try to sort it out. The c.a.b. have been marvelous and have even got the bully boys at the halifax to accept a payment plan. Unfortunately, with her annual wage, this debt will take forever to pay off. Does anybody know about I.V.A. I believe this is a scheme where you make payments for 5 yrs then the remainder of the debt is wiped out. Where do we go to get advoce on this? Another problem she has is, because of her lousey credit rating, no bank, although her monthly wage is paid into an account, will give her an account with a debit card. The account she has at the moment just has a cash card, so every other night her brother has to escourt her down to the hole in the wall to get her lunch money extra extra.

hi i myself am in a similar situation and have turned to payplan for help with my debts fortunately i am in the position to pay enuf to my creditors that they should be paid off n 5 and a half years well thats what payplan has worked out for me they also have information about IVAs on their wesite. as regards to a debit card maybe your duaghter would be better without one? as then she can see the money she is forking over and may well spend less am moving to an account with a cash card only myself as i think this will curb my spending habits.current debt standing at 27500
in a dmp with payplan feeling better about my debts
debt free: 2012
oh and i owe 8 grand student loans 2

Try and encourage your daughter to only go to the "hole in the wall" once a week - this will help her to budget.
The bank did the same to me, and only gave me a debit card at the end of last year (3 years later!!!).
I am guessing that the ex wont repay any of the money (cheeky b*stard!!! - this makes my blood boil!!).
Contact the CAB, CCCS or Payplan for some FREE impartial advice (although, thats what we're here for too!!) :0)0 -
Has she managed to keep any of his belongings she can flog? If he doesnt pay up then thats what Id be doing, that or arbitration first if she knows where he is. Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.
Theres no dollar sign on piece of mind
This Ive come to know...
So if you agree have a drink with me, raise your glasses for a toast :beer:0 -
Perhaps try using Money Claim Online - try and recover the costs. It didnt work for me because the ebay scammer had used my money to scarper off to Oz with (ooooh, if I find him when I'm out there!!!), but if you have the address of her ex then I would go for it!!!

Unfortunately unless the purchases where in her name and for items (like a sofa, car etc) then I think she's stuck here. IF there where major purchases of items like this tho then legally these items belong to her and if he has them she should be able to get them... I would consider speaking to a solicitor (most do a free 30 min consultation to see if you have a case etc). Some times a letter from a solicitor is enough to prove your serious and he might cough up.
I think it will very much depend on what the money in the debt was spent on... and what the deal was with the credit cards etc... However I would have guessed that CAB would have already considered these options if they were relevant... Is there any way of taking the ex to small claims for some of it? Or are we solely looking at how you are going to sort this without any involvement with him

Many thanks for all your replies. Her ex, scum that he is, left with everything. Yes, all the furniture etc was in her name, but she came home from work one day and the flat had been stripped, only the lord knows where he is now.0

Oh Lynda, a friend of mine's husband di this to her - ran up debts buying things online in her name, took all their furniture and PETS and left her high and dry.
She had to move back in with her mum and be skint, but now she has found a new man and is very happy.
I know that doesn't help you but I wanted to express some sympathy and support.
But if it was all in her name can she report him for theft???:cool: DFW Nerd Club member 023...DFD 9.2.2007 :cool::heartpuls married 21 6 08 :A Angel babies' birth dates 3.10.08 * 4.3.11 * 11.11.11 * 17.3.12 * 2.7.12 :heart2: My live baby's birth date 22 7 09 :heart2: I'm due another baby at the end of July 2014! :j

If she bought things in her name which he still has and she has the receipt to prove she bought them she is entitled to have all those things. She can then sell them to pay off some of the debt.
Same thing happened to me. My ex bought furniture, carpets, a shed, a car and all sorts in my name off the net with my credit card. It was a violent relationship and when we split up I ended up having to pay for all of it. I was also on benefit and nearly 60% of my money was going on repayment of debts.
I got by by going round charity shops looking for collectables/antiques and selling them off hopefully for more money on ebay. If it werent for ebay I dont know where I would be.2008 Comping ChallengeWon so far - £3010 Needed - £230Debt free since Oct 20040 -
