I don't think so, as I wreckon pretty soon the whole thing will be closed down if all 5 million (source: Ch 5 news) who are likely owed money try and claim it. Either they will reduce their charges to something that reflects the actual cost, stop providing free banking for all (which would undo a lot of work the government has been doing) or there will be a new law passed by the banks friends in government to stop it.MORPH3US wrote:I'm really happy for the people who are getting money back but its kind of worrying that this could lead to people being a lot more lacksadasical (sp?) with their money in future because they know they can't get charged.

Yes it applies to closed counts, as the offence was still committed by the bank in the eyes of the law and simply closing an account doesn't negate the law. I am well up for this - I reckon HSBC have had at least £100 from myself and my wife every month for at least a year now...
I just worry that at some point one of the banks will decide it's time to stop paying up to everyone that's trying this and take someone to court - and that'll be me!
I gather at the moment though, you can't lose?

Just get in there now ASAP to maximise your chances! In an ideal world, everyone charged unlawful penalties could claim back but I doubt somehow the banks friends in the government will allow that.
Take the evening to do it, it might be the most financially rewarding evening you've had in quite some time!
All you've got to lose is time, some stamps and, err, probably the several thousand Pounds the bank owes you.

Well the 14 day deadline for RBS to repay me just expired so tomorrow morning I'm going to start my claim against them, and they've just allowed me to add the 8% interest calculated DAILY which adds another £618.76 to my claim, bringing the total to £2,629.76! (doesn't including the £50 County Court fee which I'll also reclaim!)
So by all accounts, within 2 weeks RBS will repay the money they stole from me, and in the process will also clear the money that I owe them. Sweet, sweet justice
It took me no more than 8 hours in total to go through my 6 years of statements, prepare and send 2 letters and has cost me about £3 in total. Assuming that they cave in (most likely), it gives this activity an hourly rate of £328 :eek: Not bad for a days work

After getting approx £545 of charges in the week (yes all those charges came off in the space of a week!) commencing 5 December ( :mad: ) 2005 we went and saw an advisor at our branch and we got a goodwill refund of £200 - do you think it's still worth our claiming. Oh yeah and if they had just paid the dd's and cheques it would have been approximately half of the £545 we ended up getting charged :eek:Official DFW Nerd Club - Member no. 014

Absolutely! Go for it, it was unlawfully taken so reclaim it. Even if you've had a part payment. I would go down the route of claiming the £545 but make a note that £200 has already been paid. If you go so far as starting a claim, list all £545 of charges but say that £200 has been paid as it would be unclear exactly which of these charges has been refunded. (Doing this will save complication I believe, best to keep it simple)
Don't forget you can reclaim all charges on all accounts, open and closed, over the last 6 years.

Nghaaa, court fee isn't £50, it's £120. I can get it back and it's small fry in comparison to the almost £3k I'm claiming. I'm kinda hovering over the submit button and wondering whether I should commit to gifting a % of my award to charity before I start this ball rolling and get carried away.
You see, I've started work on 13 other cases of unfair charges, 12 for me and one for my OH. I really hope this doesn't make me a bad person
