Buying a phone used, paypal advice needed

I am buying a phone off hotukdeals for £70, although seller wants me to pay by paypal gift. I have him sending the phone via special delivery. What are the chances of me getting my money back if he sends me an empty box, lol.
I assume he wants me to pay paypal gift as he has no fees to pay, but, makes it look like im just giving my money away if there is a problem.
Am i being para?

Paypal gift is for gifting money to people you know so you will not be protected at all if you receive an empty box they won't help you, if it was me I wouldn't do it !0

it may also be worth posting this in the ebay board as well as they tend to be good with this kind of stuff.
