Argos Replacement Product

hi,
can someone tell me if argos was in the right.
i go today to replace a faulty ds lite. i have also got the thier replacemnet product cover.
the ds has a problem with the switch and i cannot turn on the ds at all like the spring has gone, it has some usual scratches and the hinge is broken but this does not impede playing the unit which was not a problem, it was the on switch. i got the replacement cover beacuse you know how kids are like.
i go to get it replaced and since i want a new one the same day and not wait for a repair i decide to get it replaced so i go and invoke the replacement cover. even tho the product is still within the 1 year guarentee with them.
i am then told that by using the replacement cover i would have voided my replacement cover and that i would have to purchase a new one for it. now is this correct as i did ask the guy at the till to show me where it says that. i then quote the sales of goods act because i only got the product from them less then 5 months ago.
he said that the only thing he could do was to send it for repair and i would get the same one back. i said it was not good enough i want a replacement under the sale of goods act. he then points out the hinge on the unit saying that the unit was missued and that he can only replace it using the cover as accident and i can have it there and then . i told him that it was not the case as nintendo know they have problems with their hinges and it was not the main problem it was the switch. being short on time, i agreed as i could not wait for it to be sent for repairs as you know what kids are like, so i went with it and he voided my replacemnet cover and then had the cheek if i wanted another one, to which i was fuming and said no cos the cover is useless because it should be 3 years.
so what can i do about it i have all the reciepts here including the original , replacement cover (now void written on it) and the new reciept to collect the replacement.

I don't think I understand - you got the DS replaced under the Replacement Product Cover, it doesn't really matter whether it was replaced due to the switch or the hinge, you got a new one, paid for out of the insurance you took out.
You've now got a new product, you need a new replacement cover - the old one is voided as they've paid out on it by issuing a new DS.
I'm not sure what you are upset about?I'm an adult and I can eat whatever I want whenever I want and I wish someone would take this power from me.

You need to refer to the conditions of the replacement cover - does it stipulate that it may only be used once, or is it a continuous policy?
I would be careful quoting SOGA when don't understand it - SOGA would not entitle you to a replacement after five months, but rather a repair, replacement or (proportionate) refund at the discretion of the retailer.Gone ... or have I?0 -

Agreed. The confusion appears to be that, and mixing up the insurance terms and your statutory rights.0 -
The Replacement Product Cover (RPC) for your DS Lite covers you for ONE use and is explained in the green booklet that you would have received with your till receipt.
If you didn't want to use your RPC to get a brand new console there and then, then Argos are perfectly within right to send it off for repair as you/your child(ren) have had 5 months use/enjoyment out of it.
RPC's are and only ever have been "one use" because otherwise Argos would see multiple returns of people who could be claiming a new item/DS each month! Obviously this would not be economical. You should have read the booklet with your till receipt, it is clearly explained in the terms and conditions of the cover, which you duly had 45 days in which to change your mind and cancel the cover, which you didn't.
3.4 This insurance is limited to one replacement product, or settlement via Argos vouchers, after which the insurance will end.
As for "he had the cheek to ask if I wanted another one", it's the job we have to do, don't get all hot headed at him for doing that.

Oh well i say this is because i took out a policy at Gamestation alot older then the one i took out at Argos With the Gamestation one i could return my faulty product as many times as i wanted and that was for accident damage as well (not accepted for missuse etc..) Had a psp replaced 2 times once for a broken umd drive and 2nd for not booting.
While going to purchase the DS lite at Argos (beacuse gamestation at the time did not have the colour i wanted and it may take more then 1 week to get hold of depending on their supplies, i brought the one from argos instead and at the time of purchase i asked about thier replacement cover and explained the one i had at gamestation, i was then sold it on the belief that it was the same and staff failed to mention at the time it could only be replaced once, even tho i did repeat about the gamestation ones many times, i was told it was the same thing by the staff and brought the cover.

Yes, you have every right to be hot headed, but it won't get you anywhere. You are better to check terms and conditions yourself before buying an item, and when returning the item, go in armed with accurate information. Retail staff hear people misquote SOGA so many times, it really does weaken your position.Gone ... or have I?0 -
With Argos you took out an accidental damage replacement policy. With Sony (not Gamestation) you effectively took out a maintenance contract which would provide you with a swap out (not brand new) unit within 2 days.
Whether you were mis-sold the Argos insurance is another matter. Taking it out on the staff who were trying to help you by explaining (correctly) what your options were just makes you "the customer from hell" and will get you no help at all.

i know i took out the argos one but never mind that, i quoted the sony and gamestation ones (before i brought the argos one) I did explain to them what i was told when i took the cover. and they did explain to me the right way, another fact is when i asked the person to point that part out on the terms and conditions he could not point it out on the policy and that took a turn for the worse especially with manager on break and duty one useless.
Oh well i have forgiven them on this one and not going to bother doing nothing.
if you was mis sold something you would be in heat as well (I still have the persons name on the reciept so i could send argos a letter to make sure his/her staff are trained well about thier cover) but as i said what done is done and im not going to take it further and embarrass the person that sold me the cover.
I have made sure that family member and friends never buy thier replacement 3 year cover (im still bitter) :j lol0 -
