3 no phone but still charging :-(

I am really hoping someone knows how to help. I have an 18 month contract with 3 which runs out in November. However, my phone broke. I sent it back to them and they say the damage isn't covered by the warrenty. I can see no damage on it but they say it must have been dropped or similar (which it hasn't). Because the repair isn't covered under warrenty it will cost £80 to fix it. I don't think it is fair I should have to pay this but probably would for an easy life. However, the phone is awful anyway. I get absolutly no signal where I live so haven't been able to use it since I moved 3 months ago. So I told them I wasn't prepared to pay £80 for a phone I don't use anyway.
I asked if I could cancel the contract, they said only if a pay £300. I asked if I could lower the contract to a cheaper one (mine is currently £35 per month) I was told no. I asked if they would at least give me a cheap phone to use (not that I get a signal anyway) they said no.
So basically I have to pay £35 for a phone I no longer have unless I want to pay an extra £80 to get it back, and still not be able to use it!!
Is there anything I can do??

Not much - you would need to prove its damage which can be repaired under warranty - not easy.
I suggest get yourself a cheap £10 phone from somewhere and at least make use of your allowance of mins and texts.
The damage sounds like its internal - in which case how did it get damaged? What were the signs it wasnt working properly?
PS My own story - My phone (N95) I got in June 2008 from o2, within first month, a pixel inside the phone blew (I heard it going). I spoke to o2 on the phone and then took it to o2 shop (both times told to send it in to evaluate). They told me its not covered I did it (I had not even touched the blasted thing, hated it so much had not even used it for a month). Sent it to them and they tell me its £63 to repair. I ended up buying the screen part from ebay (such a common fault that the part is sold readily on ebay) and I repaired the phone myself for less than £30. At one point I told o2 to get lost and cancel the contract, paying over £300 for the priviledge, decided against that route with my own repair.0 -
Warranties on phones are not worth the paper they are written on IMO!!
My OH had a motorola phone a couple of years ago which just stopped working. We took it back and they sent it off to Motorola for repair but they said that the phone had signs of water damage!! As it had never been dropped in water or even splashed by water we contacted Motorola to compalin only to asked "have you used this phone outside at all?" "Yes" we replied and was told that the air outside is cooler than the air inside your home and so condensation would be created inside the phone, if you have used the phone outside it causes water damage and invalidates the warranty!! Some MOBILE PHONE this is was my OH's reply as she called the man a T*ss*r and hung up!
Your only hope is to buy a PAYG or 2nd hand unlocked phone and use that! Sorry to say:mad:Always get a Qualified opinion - My qualifications are that I am OLD and GRUMPY:p:p0 -
Sorry I obviously didn't explain myself very well! :-)
I think it's unfair that I should have to pay for the phone repair but that isn't really the issue. The problem I have is that even if I do pay for the repair I still can't use the phone because I have no signal. So getting a cheap new phone, doing the repair myself or paying for the repair wont help me. I still have to pay £35 a month for a phone that I can't use because it has no signal. Is there anything I can do about that? Can that void a contract?

I understand your frustration, but it's not their fault that you moved to area where you cannot use it..
You signed contract for 18 months and they have you now for 18 months.. It's normal practice.
The only way could be to transfer it to someone in family who is looking for contract phone?0
