How's this for a NPB message to "buyer"?

Been having big problems with this guy who "won" my phone last monday-had every excuse under the sun off him, now he's ignoring me! So-i'm gonna send him this:
"Hello again, it's now been 9 days since you won this item, and still no notification of payment. If payment is not received by 18:47 tomorrow (March 8th), I will have no choice but to initiate non paying bidder proceedings, and leave you negative feedback."
How does that sound? Or am I being too nasty?

Why 18:47 ?

At least you arent letting them drag it out... I ended up listening to excuses for a whole month before I filed the NPB!

I put 18:47 cos thats exactly 10 days! (....i could have put in the seconds too!)

You can start the NPB on day 7, no need to wait until day 10. Also, I would caution against warning the buyer, ideally you want him to totally ignore the NPB process as that means he loses the right to leave feedback. If he is aware of the dispute process and responds he retains the right to leave you feedback.
Just start the NPB and waste no more time on him.

I also think it depends on the payment terms you put it your auction. If you have stated payment to be received in 7 days for example, I think it very harsh to file a NPB on Day 7. I allow 7 days and thankfully have never had to file a NPB. I think 10 days would be my absolute minimum and would more likely give it longer. Things do happen and there may be a genuine reason for him not being contactable lately. That being said, I think you do get a gut feeling from correspondence as to whether you are being strung along. I would consider the terms of your auction and go with your own instinct.0

Oh god, how bad do i feel.... Just got a message from my buyer saying that the reason he hadn't been in contact is because he just found out his dad has cancer.
I think i may well go to the bad burny place for that.
