JML - Best Way to Return Halogen Ovens

    no dsr would only cover the second unused oven. like you say, it basically gives you the chance to do what you would do in a shop, not actually use it.

    However, their T&C,s dont take away your statutory rights, and so soga still covers you. so for the first used oven do as i said in my first two posts. BE PERSISTENT, if they ignore you ask to speak to a manager and so on etc. You were mis,sold goods that are not for for purpose, and soga makes you entitled to a repair or replacement if the product is faulty.

    But be warned, if the product is faulty you dont have a right to a refund if there is no warranty. Yo just have a right to a repair or replacement. If there isnt a fault, then you were mis sold the cgoods and you need to request a full refund. In any of the cases you shouldnt incur a single cost.

    Thanks Josh. I don't fully understand your last paragraph. SOGA states:

    If you buy a product that turns out to be faulty, you can choose to 'reject' it: give it back and get your money back. However, the law gives you only a 'reasonable' time to do this.

    I assume we do not need to wait until until they decide if it is faulty?

    right, well they is where the law gets a little "grey" as it were, when they use the word reasonable.

    basically you have 6 years that you are protected by soga, now this doesnt mean all products are covered for this long but rather up to this amount.

    The actual time you are covered is what a "reasonable person" would expect a product to last given the nature of the product and the price paid.

    Now, im 99.9999% sure that if the oven IS faulty (it ma not be), i would say that that is NOT what a "reasonable person" would expect of this product in the time period you have had it. So bascally how this covers you now is that when you write to them, you say it is not "fit for purpose" as it does not cook faster than a standard oven as stated. So you need to write to them like i said and demand they collect the oven to be expected by them ( under soga, this is their responsibility for the first 6 months of ownership, it is your responsibility thereafter.) They should then inspect it and find out wether it is faulty, if it is they MUST repair or replace it as you are covered by soga. If it is not then they MUST give you a full refund as it was mis sold, so really it is a win-win situation.

  • I was going to return the unopened one under DSR and try the one mum has used myself and if that is still faulty return that under SOGA.

    However, was just drafting email and had a thought. If I am only returning 1 of the ovens, that isn't the whole contract. Will that be a problem, will I stll be able to return under DSL - can't find anything.

    its ok and soga covers products so it wont confuse things. same if you buy two sizes of a top from a shop, you just take back the one you dont want, not both, if that makes sense lol. But yes use dsr for the un used oven. make sure you write two different emails for them so it does not confuse the issue. quote the order number aswell.
