The Scout Assocciation receives every local and national daily and weekly newspaper printed in the UK. From these, they clip any article involving a court case where the defendant is found 'not guilty'. These clippings are logged on to a computer database, and the article is filled for future referance. So not only do they carry-out enhanced CRB checks, but also internal checks on their own 'not guilty' database. Where a person is flagged-up on this, they issue a 'Known to us' warning.

A lot of companies now pay to run their potential recruits through the Scout Assocciations checking system.

    Is that even legal?
  • Is there any more news on this case?

    Cheers, HG

I would also be interested if any more had happened and how the planning for the ET was going.

    best wishes and courage.

It's amazing how those with a can-do attitude and willingness to 'pitch in and work' get all the luck, isn't it?

Please consider buying some pet food and giving it to your local food bank collection or animal charity. Animals aren't to blame for the cost of living crisis.

Well done standing up for your honour. It's not been easy or pleasant to even read this never mind live it. I was thinking a few pages back..."OMG lucky no-one was murdered on your client list". This daft old bat could have lost her cash somewhere in her home and forgotten it .

Well done for putting up with the professional troll too.

I had a spat with an employer once and it was nothing compared to this...but I wasn't having it and fought them....I too got offered cash to go away and for them to be able to forget it. No way. They were MADE to pay more, embarrassed to hell and back in the tribunal (you have been on the wrong end of that, see how much fun it it to see a bad boss in that position)...my ex boss was told that "he shouldn't be allowed to employ people" ..and it got in the local papers for a last twist.

Wishing you the success your perserverance deserves. Not just for you, but for all people in such a vulnerable post caring for others. Every win makes them stronger if this happens again.

CRBs only show criminal offences for which you are found guilty. if you are found not guilty, then this won't (or shouldn't) appear. However, if any future employer also does a Scout Assocciation check, then they will report back on not guilty cases involving you. But they won't list the alleged offences, just tell the employer that they need to be carefull of employing you.

I know this is correct as I asked myself what CRB checks involve when I did one as a Scout Leader.

there are three levels of crb disclosure.
    basic, standard and enhanced.

speaking with regards to the enhanced and in terms of it been requested for a person applying to a caring for vulnerable adults post (where an enhanced would always be the level of crb requested).

the body of the crb would only show charges or cautions to which you have been found guilty, however, there is also a section at the bottom of the disclosure that can be completed at the discretion of your local police station.

comments here could include information that your local police station deems relevant for your potential employer to be aware of, and in this case, the allegation of theft is likely to be recorded here.
  • Hi sexyeyes83,

You haven't updated us for a while, hope everything is okay with you!
Hope to hear from you soon.
  • Hi, sorry about the lack of updates.

Ive been rebailed a further 3 times since my last update. The PC dealing with the case has got a face to face meeting with the CPS on the 24th November, so im going to see him that afternoon and he reckons he should have an answer by then.

Ive submitted two cases to the employment tribunal - One for unfair dismissal and one for discrimination. Both have been accepted by the employment tribunal.

Received the ET3 form back regarding the unfair dismissal which they are defending.

Today I received a letter from the company representing my employer regarding the ET3 for the discrimination.
12th November - By Email Only - Urgent

We act for the Respondent, and write to respectfully request a short extension of time within to file Notice of Appearance (ET3). The ET3 is attached herewith. If a default judgement has or is being issued, we would respectfully request a review of the decision on the same grounds, as stated below.

We failed to submit an ET3 by the deadline of 5th November 2009 due to an administrative error, which was in no way the fault of our client. We received the papers from our client on 21st October 2009 but they were misplaced due to an administrative oversight.

We have acted promptly and without delay upon realising that an ET3 has not been submitted in these proceedings.

We have previously submitted an ET3 for the claimants claim under case number XXXX/XXXX and both claims by the claimant arise out of the sae circumstances.

The respondent does have reasonable prospects of success in these proceedings. A short extension of time within which to submit the ET3 will not prejudice the claimant and will ensure that the interests of natural justice are served.

Please kindly place this letter before an Employment Judge as a matter of urgency.

Not to sure what happens from here, whether the judge will except their excuse. In a way I hope he dosent. The company representing my employer are a large national specialists, so seems they should look after there paperwork a bit better.

On a happier note, Ive got a new job and ive also attended an interview for a new supermarket thats opening up in town at the start of next year, which went very well!

Just want the police investigation to be over with so I can enjoy by birthday at the end of the month and xmas!
  • Glad to hear you are working elsewhere. Hope it all works out for you and you get a bit of peace!
