3 mobile are they in breach of contract !!

I hope someone can help me out with getting out of my 3 mobile contract ??
I am in my third year contract with three mobile, surprisingly I have had few problems with them in the past, until I got the LG Viewty on my latest upgrade, the signal in my area has been bad since I got it, but I presumed it was just three's bad service and perserviered with it.
It has recently got to a point now where I cannot make a phonecall from home, and when I contacted customer services they addmited there is a known manufacturers fault with the phone, I have 9 months left on the contract, all they have offered me is a replacment phone of either Nokia N95/ erricson W850i, I told them I did not want either phone as it is not the same specification or better than my LG, I finally got through to supposidly a manager in the cancelations team, and explained I did not want to accept the phone and that they should void the contract free of charge, in compensation for me being unable to use my free minutes.
He would not budge on this offer and told me I would have to pay £239, I left the conversation saying I would no longer be using three's services as of today and would not be paying my bill !!! Do I have a way of not paying the cancelation fee !!! PLease Help !!!!!!!

Shouldn't they offer you a new LG first if it's a known manufacturers fault? I am not 100% on this though

It could be 3G (Fast internet) that is causing your signal to be incredibly poor, it has this effect on some handsets.
Try doing this:- Tap the Menu key.
- Tap the Settings key.
- Tap Phone settings.
- Tap Connectivity.
- Tap Network settings.
- Tap Network mode.
- Tap GSM 900/1800.
- Tap Select.

The problem isn't with 3s network, its with the handset. They have told you there is a problem with that model and offered you alternatives to resolve the matter. This isn't linked with the Watchdog report, which was about the lack of network signal, not problems with the handsets. They aren't in breach of contract, infact they are doing everything they can to help you out, so I can't see a way you can get out of the contract without paying the cancellation fee...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

I've known people have 0 signal with 3G activated, turn on 2G and revert back to 5 bars.

Will they still be thanking you when Three disable the account in a few months for using their 2G network?
Do they not lock this option in the firmware like they do with Nokia's out of interest?0 -
So, to summarise:
There is a fault with the phone which is a manufacturer fault, Three offer you a replacement or alternative handset, you refuse and tell them you aren't paying your bill. I'm suprised the call centre person didn't laugh when you say that. You will be paying for it one way or another either with money, a damaged credit file for six years, or both.
I appreciate that the N95 8GB isn't a touch screen, it is still a more expensive phone they are offering you, presumably for the same monthly line rental. I couldn't find the other phone you mentioned on the Three website so I don't know about that one.0
