What exactly have they said?
Give us the exact dates of all events, one by one, clearly and dates of phone calls if you have them.

I wanted to ask .. What is the best thing I can do now? shoudl I tell the seller that i want to act legally? and how to start legal action? ( never done anything like that before) A BIG THANK YOU TO EVERYONE0

- bought the car on the 13/09/08
- the car had a tax disc that would had expired on the 30/11/08
- car was impounded on the 18/11/08 and was told that the disk was invalid
- paid £221 for release
- 02/01/09 got a letter from DVLA saying that I had to pay £100 (out of court settlement) because the car was used unlicensed way before the car was impounded
- I wrote DVLA and send them copy of the disk that was left with the car, copy of the V5, and ask for refund (because I was sure the disk was valid)
- On the 8/01/09 DVLA wrote me back saying that the Agency will be making further enquiries and will write back when these have been concluded.
- while waiting I called the seller to know if she ever got refund for the disc and she said that she bought the disk online and never got a refund
- same day I called DVLA to know what information they had on the system
- the disk was bought in June and refunded in July 2008
- on the 13/02/09 got a letter form DVLA saying: that they forwarded my details to the local authority where the impound took place
- 17/03/09 letter form local authority: I regret to inform you that I am unable to authorize the refund on this occasion. This is due to the following reasons:
it is the keeper's responsibility to ensure that the vehicle is correctly taxed;
The vehicle was in use on the public highway
There was not a valid tax in force for this vehicle0 -
You will need to ring the DVLA on Tuesday and get to the bottom of this refund in July.
Confirm it was a refund and the fact the disc was not made "void". If it was a refund did they have the disc returned?

apparently the seller called dvla saying that she lost the disc and aske for a refund ..the disk was the orginal one on the car but was invalid0

she didnt she scammed them and me...
she said to have lost the disc ( but she lied) she kept drving with that disc ( even after she got refunded) then in spet sold me the car saying that the disc was valid till november the 300 -
Was the car advertised with tax? If so, have you kept the advert?0
