Moorcroft CCA request. Any help please!

Keep this as brief as poss…
I CCA requested Moorcroft for an old Abbey debt (1999) and whilst what they provided looks OK I suspect they have “cut & pasted” the details together.
One thing that makes me suspicious is that they returned the £1 statutory fee along with a statement saying they would keep the account on hold until xx/xx/xxxx.

Qu 1…Why would they do this if what they provided was genuine? Anyone had any experience of this?

Qu 2…I sure I’ve read somewhere that you can request to visit their premises and have sight of the original signed document? Anyone know if this is true and if so, do you have a standard/template letter I could use to request this.

Thanks in advance.

If they took you to court , they would need to show the original agreement. If they turn up with what you say looks very suspect , they would be in very big trouble .

    Cheerz,

    That's reassuring.
I'm still however thinking that I would be better knowing what they had before it went to court just to make sure.
I'm guessing that if they had anything concrete they would have gone to court by now (10 year debt).

Thanks, these are the 2 letters they sent. Not sure how to up-load the CCA.

    1st letter

I refer to your recent correspondence. We are continuing to seek to obtain a copy of the credit agreement that you have requested. Our systems provide for reviews to be sent to our clients on a regular basis and this we are continuing to do. I will contact you again just as soon as the agreement has been made available to ourselves and confirm that at this stage the account has been placed on hold and that we shall not seek to enforce the debt until such time as the agreement has been obtained.

In the meantime however we believe that it may be of assistance to all parties if we take the opportunity to ensure that any potential areas of dispute are addressed prior to any possible court action or further investigation. Please could you give an indication of the information you will be providing, when giving evidence to the court or providing information to the relevant statutory authorities in relation to the alleged subject matter of the account.

Please could you provide this information by return. We believe this is a simple request that will ensure that all possible areas of dispute are identified as quickly as possible and potential costs and delays kept to a minimum level.

2nd Letter (received 3 days after the 1st)

Please find enclosed a copy of the relevant agreement under the Consumer Credit act in relation to the above account. I also return your payment of £1 submitted in respect of your request.

I can confirm that I have placed your account on hold until XX/XX/XXX and request you make immediate contact with our call centre on the above telephone number to discuss a repayment proposal you can afford and maintain.

Bog standard letters from Moorcroft. Returning the £1 means nothing really. I suspect it is too much hassle to cash all of those.

Scan in the agreement, blanking out any personal details or things that could identify you.

Then posts here as an image.

  • I sent Moorcroft a letter asking for the agreement-they cashed the cheque in January but never provided a copy of the agreement. They have now sold the debt on to Equidebt-but I still haven't seen the agreement. It was originally requested at the beginning of December, cheque was cashed on January 4
