It's an application form ;) from what I can see, it has the prescibed terms, making it enforceable.

I was also looking through my old records today & found many of the offers that Abbey continuously sent out as an invitation for the loan. They all talked about a decision in principle in 1 hour & the loan money sent out in a matter of days so I can't see how they could have set the CCA up correctly.

Guess I'm looking for a few more opinions on this application form/CCA then I'll think about getting my reply letter together.

    Any more thoughts.

Thanks for all ya help so far.

Have they sent any T&Cs with the above CCA?

No just this and the covering letter.

Do you have PPI on this?

As this looks enforceable I got to think is is possible Moorcroft have cut & pasted the signiture. Effectively joined it together from seperate docs???

Or am I barking up the wrong tree?

OK, this is my opinion on it, the CCA it contains the prescribed T&Cs making it enforceable, although they've not issued the T&Cs when you took the agreement out.

You could dispute it on the basis the T&Cs are missing from the agreement, but I'm sure if it came to court a judge would find in favour of the claimant.

As I say, that's just my opinion ;)
