Cancelling an Upgrade

After requesting my PAC from Vodafone I received a phone call making me an upgrade offer which I accepted. After consideration I decided that I wasn't happy so I returned the phone within the 14 day period. Their terms and conditions state

If you decide to do this, we'll cancel your contract and your old airtime agreement will continue as before.

However, I later discovered I was being charged an extra £5 per month for line rental and when I queried this was told by CS that my old airtime plan no longer existed and they had placed me on the nearest currently available plan. Isn't this illegal?

You should have been placed back on the tariff that you were on before you upgraded. Even price plans which are discontinued for new customers are still available to be provisioned in cases of DSR upgrade cancellations.

This. You should have been placed back on your original plan, because that is what your contract was originally for.
