Problems with a T-Mobile phone i just upgraded to

I recently purchased an MDA Vario 4 as an upgrade on an 18 month contract and paid the sum of £300 including the discount given to me by t-mobile of £80. I have had the mobile for 2 months now and it has been back to the for repair after only one month and then back again to them today (2nd month). The problems that I am experiencing make the phone virtually unusable. Some of the problems being that it freezes up almost any time you want to do something even when trying to complete the most simple of tasks like making a phone call, if I am on a call to someone it will disconnect them after a few minutes and sometimes cut them off but keep the call connected, I can’t get out of this so it means I have to remove the battery in order to get it back up and running. I have an unlimited web and walk facility with the phone but on most occasions can’t use it because it drops the connection all the time, even though the phone is 3g I have only ever managed to get it once. At best I get 3 bars of signal and mostly only get 1 or 2 bars no matter where I am. If I try to answer a call it freezes up on me and refuses to answer requiring me to almost always phone them back. I have bought a tomtom mobile card for it but can’t get it to work as it will not pick up any satellites, I even tried co-pilot that came with it and yet nothing.

The phone is unusable to say the least. I can’t even do the most simplest of tasks half the time like making and receiving a phone call. I am not a business use but I do use my phone a lot so I want something that has the features and is reliable.

When the phone came back the first time I asked what was done and they said all that was written on the docket was "Screening" which they informed me was basically just looking at it even though the guy in the t-mobile shop said it would have a software upgrade, I wasn’t happy to say the least. I turned the phone on and showed them that there were still problems with it, to which they said they would do a hard reset there and then. After all that it seemed to work fine if a little glitchy. The manager then told me how to do the hard resets and to take the phone away and try it out if there were any more problems to come back. Since then I have done 5 soft resets and 3 hard resets and to anybody that knows when you do a hard reset it wipes the phone clean and installs everything back on there so it means that I have to backup and restore everything every time. And then today it froze while I was in the shopping centre so I took it straight to them and showed them and told them how dissatisfied I was with the phone. His reply was that there was nothing as a store they could do other than to send it back to get it "repaired" and advised me if I wanted to take it any further to get it contact with t-mobile customer services and make a complaint which has frustrated the hell out of me because it means that know I am without a phone for yet another week and they can’t/wont sort it out for me.

I have done my homework and have been on almost every forum imaginable to find out what if anything there is I cant do to try and fix it, but it seems that there are a lot of people having this problem with the phone which happens to be on multiple networks and made by the same company HTC who then give it to the network providers to put their own name on it. There are fixes but it involves installing a load of other stuff which will instantly invalidate the warranty which I am not prepared to do

I have been told that if it is sent off for a 3rd time and it doesn’t get sorted that they will give me a replacement with the same phone which I defiantly do not want as my confidence in this phone to do even the most simple tasks has been knocked for six. Where do stand with all of this because as it stands at the moment I haven’t been able to use my phone as a phone for almost 2 months now as it is not fit for purpose and I am not happy at all. What do I do? What can I do?

    The whole 3 times repaired then exchange thing isnt a solid rule, Its down to a manager if they want to do it or not. Try emailing [EMAIL="cust.rel@t-mobile.co.uk"]cust.rel@t-mobile.co.uk[/EMAIL]. Usually very good at resolving issues.

    Best thing you can do with any HTC phone is wipe the network crap and take it back to basics. It's the first thing I've done with any htc phone i've ever used and never had an issue. The network software is just awful and does more harm than good. I'm sure you'll find that anyone with an htc phone who has removed the network operators software is more than happy. If you do it properly and follow the instructions closely, bricking your phone is near impossible.
